ORDER THIS MATTER, involving two separate attorney trustee proceedings and a civil action, having been brought before the Court by Michael McCormick, Esq., of the New Jersey Lawyer’s Fund for Client Protection, by way of an Order to Show Cause regarding David J. Khawam, a disbarred attorney for whom David Sufrin, Esq., of Zucker Steinberg Sonstein & Wixted, P.A., was appointed attorney trustee; and Mr. Khawan having held a property interest in the building in which Robert E. Barth, Esq., a recently deceased attorney for whom William Cook, Esq. was 1 CAM-L-000979-23 04/05/2023 Pg2of3 Trans ID: LCV20231189843 appointed attorney trustee, had leased space for his law practice; and Mr. McCormick, following an investigation, having alleged that Mr. Khawam both improperly assumed possession of client files and other equipment from Mr. Barth's practice and requested payment for the return of a client file; and Hoe Chin Kim, Esq., of the Office of Attorney Ethics, having investigated reports of Mr. Khawam’s alleged unauthorized practice of law following his disbarment; and Mr. Sufrin having separately alleged that Mr. Khawam is not cooperating in his own attorney-trustee matter; and the Court having heard from all parties at the April 5, 2023 Order to Show Cause hearing; and for good cause shown; IT IS on this 5" day of April, 2023: 1 ORDERED the contents of the Scheduling Order entered on April 4, 2023 in the matter docketed under CAM-L-979-23 is incorporated, subject to modification herein; and 2 IT IS FURTHER ORDERED that on or before April 10, 2023, Mr. Khawam shall turn over to Mr. Cook or his designee any and all files, records, and property of the law practice of Mr. Barth, wherever such files, records, and property may be situate, including but not limited to client files, computers, and hard drives; and 3 IT IS FURTHER ORDERED that Mr. Khawam is restrained and enjoined from contacting former law clients of Mr. Barth, including but not limited to any telephonic or electronic solicitation of said clients with respect to any legal file, case, or cause of action; 4 IT IS FURTHER ORDERED that on or before April 10, 2023, Mr. Khawam shall provide Mr. Cook, Mr. Sufrin, Ms. Kim, and Mr. McCormick with a certification listing everything removed from Mr. Barth’s office space, who removed the same, and when, and where said items are presently located; and 5 IT IS FURTHER ORDERED that on or before April 10, 2023, Mr. Cook, or a designee in his place, shall be authorized to enter Mr. Khawam’s property where Mr. Barth 2 CAM-L-000979-23 04/05/2023 Pg 30f3 Trans ID: LCV20231189843 practiced and search for any items, including but not limited to client files pertaining to Mr. Barth’s practice; and 6 IT IS FURTHER ORDERED that the computer that was used by Mr. Barth’s paralegal, Margot Osorio, regardless of ownership but in possession of Mr. Khawam, shall be turned over to Mr. Cook or a designee on his behalf no later than April 10, 2023. Ifa username or password is required, Mr. Khawam shall provide the same to Mr. Cook or the designee to secure access to the computer. Once Mr. Cook has inspected the electronic contents of the computer for anything pertinent to Mr. Barth’s legal practice, Mr. Cook shall thereafter return the computer to Mr. Khawam; and 7 IT IS FURTHER ORDERED that Mr. Khawam shall fully cooperate with Mr. Sufrin in the course of his own attorney-trustee matter; and 8 IT IS FURTHER ORDERED that on or before April 10, 2023, Khawam shall provide a certification to Mr. Cook, Mr. Sufrin, Ms. Kim, and Mr. McCormick specifying where and to whom he sent his own client files; and 9. IT IS FURTHER ORDERED that or before April 10, 2023, Mr. Khawam shall provide a certification to Mr. Cook, Mr. Sufrin, Ms. Kim, and Mr. McCormick describing the entity known as New Jersey Law Group, LP, including but not limited to, the addresses, phone numbers, names of any affiliated or associated attorneys, the registered agent, the owners, and incorporation papers; and 10. IT IS FURTHER ORDERED that a copy of this Order shall be served upon all parties within seven (7) days of the date of this Order.
