INTRODUCTION 3 Specially-appearing Defendants GlaxoSmithKline, LLC, Boehringer Ingelheim 4 Pharmaceuticals, Inc., Boehringer Ingelheim USA Corporation, Sanofi US Services, Inc. and Sanofi- 5 Aventis U.S., LLC (collectively, the “Brand Defendants”) seek to place under seal certain portions of 6 the Brand Defendants’ Motion To Strike Plaintiff’s “Rebuttal” Expert Nephrologists Dr. Mony Fraer 7 and Dr. Guarav Jain (“Motion To Strike”), including concurrently filed Exhibits A through P and 8 Exhibit R to the Declaration of Emily Van Tuyl in Support of the Brand Defendants’ Motion To Strike, 9 so as to maintain the confidentiality of Plaintiff’s medical and personal information. 10 II. ARGUMENT 11 Pursuant to section VIII, paragraph 3 of Pretrial Order No. 2, any motion “that discloses, 12 summarizes, describes, characterizes, or otherwise communicates” confidential information “must be 13 filed with the Court under seal, in accordance with California Rules of Court Rule 2.551, et seq.” JCCP 14 51510 PTO No. 2, § VIII ¶ 3. Under CRC Rule 2.550(d), upon motion by a party, a court may seal 15 publicly-filed documents if: (1) there exists an overriding interest that overcomes the right of public 16 access to the record; (2) the overriding interest supports sealing the record; (3) a substantial probability 17 exists that the overriding interest will be prejudiced if the record is not sealed; (4) the proposed sealing 18 is narrowly tailored; and (5) no less restrictive means exist to achieve the overriding interest. Cal. Rules 19 of Court, rule 2.550(d)(1)-(5), (e); NBC Subsidiary (KNBC-TV), Inc. v. Super. Ct., 20 Cal. 4th 1178, 20 1217-18 (1999). The trial court has “a considerable amount of discretion” in deciding whether to seal 21 a record. In re Providian Credit Card Cases, 96 Cal. App. 4th 292, 295 (2002). All five factors are 22 satisfied here. 23 A. The Overriding Interest of Maintaining Privacy for Medical and Personal 24 Information Merits This Court’s Protection. 25 A court has inherent power to control its own records to protect rights of litigants before it, but 26 “where there is no contrary statute or countervailing public policy, the right to inspect public records 27 must be freely allowed.” Craemer v. Superior Court, 265 Cal.App.2d 216, 222 (Ct. App. 1968). In this 28 6 BRAND DEFENDANTS’ NOTICE OF MOTION AND MOTION TO SEAL THEIR MOTION TO STRIKE PLAINTIFF’S “REBUTTAL” EXPERT NEPHROLOGISTS DR. GAURAV JAIN 1 case, there is a countervailing public policy in protecting Plaintiff’s medical and personal information. 2 The Motion To Strike pertains to experts who opine about Plaintiff’s health. This information would 3 not ordinarily be in the public domain but for his role in this litigation. 4 Moreover, many of the exhibits the Brand Defendants seek to seal have been designated by 5 Plaintiff as “CONFIDENTIAL – SUBJECT TO PROTECTIVE ORDER” (specifically, Exhibits A, 6 B, C, O, and P). The nature of confidential information creates an overriding interest in maintaining 7 the privacy over the sensitive information specific to Plaintiff in the context of the Motion to Strike 8 and warrants sealing. Thus, the Brand Defendants submit this Motion in an effort to preserve Plaintiff’s 9 right to privacy over the medical and/or personal information at issue in the Brand Defendants’ Motion 10 To Strike. 11 Accordingly, the overriding public interest in protecting Plaintiff’s right to privacy over 12 confidential information in the context of the Brand Defendants’ Motion To Strike outweighs the 13 public’s right of access, thereby satisfying the first three requirements of California Rule of Court 14 2.550(d).1 15 B. The Brand Defendants’ Motion to Seal is Narrowly Tailored and No Less 16 Restrictive Means Exist. 17 In addition, the Brand Defendants’ requested relief is narrowly tailored such that no less 18 restrictive means exist to protect Plaintiff’s confidential information. Cf. NBC Subsidiary, 20 Cal. 4th 19 at 1223 (finding a “blanket and sweeping order closing the courtroom during all nonjury proceedings” 20 was not narrowly tailored to serve the interest of protecting civil litigant’s right to a fair trial). Here, 21 the Brand Defendants seek only to seal documents that are, contain, or reference Plaintiff’s medical or 22 personal information and/or information Plaintiff has designated as “CONFIDENTIAL – SUBJECT 23 TO PROTECTIVE ORDER.” Because this motion is limited to those documents that are necessary to 24 protect that information, no less restrictive means exist here.
