The Court rules on this matter without hearing. Cal. Civ. Proc. Code § 166(a)(1); Sac. Sup. Ct. Local Rule
2.235(A); see also Wilburn v. Oaldand Hospital (1989) 213 Cal.App.3d 1107, 1111. The Court has reviewed
the ex parte application and its supporting papers. No opposition was filed.
Defendant brings an ex parte application effectively seeking a modification of this Court's August 5, 2022 order
on Plaintiffs ex parte application of such date (ROA 108). In that order, the Court required that any opposition
papers (to Plaintiffs five motions therein at issue) shall be due for service and filing by August 12, 2022. By
this application, Defendant seeks a modification such that its opposition papers shall be due one court day later,
on August 15, 2022.
The Court GRANTS Defendant's application. The Court's prior order of August 5, 2022 (ROA 108) shall be
modified such that any opposition papers shall be due for service and filing by August 15, 2022. The Court
orders no further modifications to the Court's August 5, 2022 order. Specifically, the Court does not modify the
due date for Plaintiffs reply filings, especially given that the request for shortened time and an abbreviated
briefing schedule was sought by Plaintiff in the first instance. The Court need not allow reply filings at all, but
will continue to do so for these motions given that such due date shall remain unchanged.
