Tentative Ruling:
The Court has read and considered the Joint Case Management Statement filed by the parties and now
issues the following tentative ruling:
NO APPEARANCE REQUIRED.
The matter is continued as requested by the parties to September 8, 2022 at 1:30 p.m. in this
department to give the parties the opportunity to continue their settlement discussions and possibly
resolve the dispute. If the parties have not made meaningful progress by that date, the Court will require
an appearance at that hearing.
The Court is also aware that Defendant has not paid the complex case fees. Those fees shall be
paid forthwith.
The parties shall meet and confer in good faith at least 30 days in advance of the next CMC to prepare a
Joint Case Management Statement that updates the Court on the outcome of the settlement discussions
and any other issues relevant to case management.
If the parties do not resolve the matter and anticipate moving forward with litigation, they shall discuss
and outline in the CMC Statement the next steps anticipated in the litigation, including:
- Anticipated discovery schedule;
- Anticipated discovery disputes;
- Possible deadlines for Plaintiff's Motion for Class Certification;
- Other anticipated motions and deadlines for filing those motions; and
- Any other issues that should be considered by the Court or addressed in its case management order.
A joint Case Management Conference Statement must be filed no later than 15 calendar days prior to
the next CMC. All matters discussed during the meet-and-confer session shall be itemized and reported
in the joint CMC Statement. Individual statements will not be considered. Do not use Judicial Council
Form CM-110 for the joint CMC Statement, as it is not well-suited for complex cases. The purpose of
the joint statement is to require counsel to confer. It shows the Court that the parties have been in direct
communication. The CMC Statement shall include a declaration that the parties have met and conferred
in good faith on all subjects set forth above. If no meet-and-confer session occurs, or if some of the

issues above are not discussed, the parties shall provide the Court with a brief and reasonable
explanation.
Counsel for each party who appears at the CMC shall be thoroughly familiar with the case, and must be
prepared to discuss and commit to the party's position on the issues outlined above.
To request oral argument on this matter, you must call Department 28 at (916) 874-6695 by 4:00 p.m.,
the court day before this hearing and notification of oral argument must be made to the opposing
party/counsel. If no call is made, the tentative ruling becomes the order of the court. (Local Rule 1.06.)
Parties requesting services of a court reporter may arrange for private court reporter services at their own
expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956.
