Canul CASE NUMBER: 16CV300096 ORDER AND NOTICE OF INFORMAL DISCOVERY CONFERENCE An informal discovery conference for the above-entitled case has been set and you are directed to appear as follows: Date: April 13, 2023 At: 3:00 p.m. In: Department 19 Location: Superior Court, 191 North First Street, San Jose, CA 95113. The above conference has been scheduled by the Court at the request of the parties. The parties’ discovery meet and confer obligations require an actual conference (in-person, telephonic, or by videoconference). Each side must serve and lodge a short brief, (on pleading paper and limited to no more than 6 pages, briefly discussing the issues to be addressed ) by noon, at least two court days prior to the conference. No exhibits may be attached to the brief. The purpose of the brief is to provide the Court with an overview of the outstanding issues and is not to be used in place of a motion. Personal appearances are not permitted at this time; all appearances must be made through MSTeams (or a remote platform provided by the parties). Counsel is directed to use the appropriate Teams link posted on the Court’s website: Lead counsel with full authority to resolve the discovery dispute must appear unless excused by the Court. Under Code of Civil Procedure Section 2016.080(c)(2), the time for bringing any motion to compel is tolled starting on the date a party makes the email request for an informal discovery conference to the Court. If the discovery dispute is not resolved following the discovery conference, any party may proceed to file a motion. Any such motion must be filed within ten (10) court days of the conference, or within the 45-day statutory time, whichever date is later, unless otherwise specifically ordered by the Court.
