         Upon the motion made by M-M2 RE Holdings 4, LLC on February 27, 2023, which

seeks an Order of this Court confirming the Report of Sale filed in connection with this

foreclosure proceeding on November 1, 2022, and requesting an Order of the Court directing that

the surplus monies described in it, be paid to M-M2 RE Holdings, LLC, and, upon the

Affirmation of Kenneth M. Stenger, Esq., and the Affidavit of Michael Milea, each submitted in

support of that application, and, upon the proceedings previously had before this Court, now,

therefore, the Court does hereby



         ORDERED, ADJUDGE and DECREED that the Report of Sale filed in connection with

this matter on November 1, 2022, shall be and hereby is, in all respects confirmed; and further it

shall be
       ORDERED, ADJUDGED and DECREED that the surplus monies, as described in the

aforesaid Report of Sale, in the amount of $186,821.82 shall be paid to M-M2 RE 4 Holdings,

LLC, and it is further



       ORDERED, ADJUDGED and DECREED that the Commissioner of Finance for

Dutchess County shall pay such surplus monies to M-M2 RE 4 Holdings, LLC, together with

interest which has accrued upon the same and after deducting all statutory fees.
