The Court adopts its tentative ruling as the final order of the Court, as follows: ANALYSIS: On December 28, 2021, Plaintiff Old Republic Surety Company (“Plaintiff”) initiated this interpleader action against Defendants Double Oak Construction, Inc., George Gral, Laurie Gral, and Art Alfaro (“Defendants”). This action arises from a dispute over construction Bond No. WCL5923616 (the “Bond”) in the penal sum of $15,000.00. (Compl., ¶6.) Pursuant to an Application and Indemnity Agreement, Defendant Double Oak Construction allegedly agreed to indemnify Plaintiff in exchange for issuance of the Bond. (Id. at ¶¶5-9.) Defendant Double Oak Construction disputes claims made on the Bond and instructed Plaintiff not to pay those claims. (Id. at ¶7.) The remaining Defendants are alleged to have made claims on the Bond.
