20 PLEASE TAKE NOTICE that on May 26, 2023 at 8:30 a.m., or as soon thereafter as the
21 matter may be heard in Department 17 of the above-entitled court, Defendant PAVLETICH
22 ELECTRIC & COMMUNICATIONS, INC. (hereinafter “Defendant”) will, and hereby does,
23 move the Court for an order granting summary judgment against Plaintiff ZURICH AMERICAN
24 INTERNATIONAL COMPANY (hereinafter “Plaintiff Zurich”) and Plaintiff-in-Intervention
25 HUGO GOMEZ (hereinafter “Plaintiff Gomez”) and for costs incurred in defending this suit, and
26 for all the other relief the Court deems proper.
27 This case arises out of a February 21, 2018 incident involving Plaintiff Gomez who
28 alleges that he sustained personal injuries when he tripped and fell over a pipe sticking out of the

1 ground while working at a construction site. Plaintiff Gomez’s Complaint alleges the following
2 causes of action against Defendant: 1) Premises Liability; 2) General Negligence. Plaintiff Zurich
3 wrote Workers’ Compensation insurance for Plaintiff Gomez’s employer. Plaintiff Zurich’s
4 Complaint alleges the following causes of action against Defendant: 1) General Negligence.
5 The undisputed facts demonstrate that Defendant is entitled to summary judgment as a
6 matter of law because there is no admissible evidence establishing the key elements of Plaintiffs’
7 claims, particularly that any negligence on the part of Defendant caused Plaintiff Gomez’s alleged
8 injuries There are no triable issues of material facts and Defendant is entitled to summary
9 judgment as a matter of law.
10 If, for any reason, this Court is unable to grant full summary judgment, Defendant moves, in
11 the alternative, for summary adjudication. In that instance, Defendant respectfully requests that this
12 Court issue an order adjudicating that the following issues are established against Plaintiffs:

14 to Plaintiff Zurich’s First Cause of Action for General Negligence because Defendant did not
15 breach its duty to Plaintiff.
16 SUMMARY ADJUDICATION Basis No. 2: Defendant requests summary adjudication as
17 to Plaintiff Gomez’s First Cause of Action for Premises Liability because no dangerous condition
18 existed on the property.
19 SUMMARY ADJUDICATION Basis No. 3: Defendant requests summary adjudication as
20 to Plaintiff Gomez’s Second Cause of Action for General Negligence because Defendant did not
21 breach its duty to Plaintiff Gomez.
22 This motion is based upon this Notice, the Memorandum of Points and Authorities, the
23 Separate Statement of Undisputed Material Facts, the Declaration of Zsuzsanna Veres with exhibits
24 in support thereof, the Declaration of Andrew Sweaney, the Declaration of John Pavletich, all other
25 matters of which the Court may take judicial notice, the oral argument of counsel, pleadings already
26 on file with the Court, and all other evidence that may be presented at the hearing on this matter.
