Because King Fuels chose not to exereise its right to purchase the Ennis Shell store, King Fuels lost out on the right to get a new fuel supply contract im place. This is what we have discussed several times im the past when the Thompsons made good faith attempis to try 10 get King Fuels to purchase the Ennis Shell store afier the expiration of the asset purchase agreement. On December 31, 2008, the existing fuel supply contract for the Ennis Shell store expired and there is no existing fue! supply. While there is an existing refiner agreement between King Fuels, Inc, and Shell Oil Company, there is no fuel supply contract for this store. White the new operator would have to get Shell's permission to change to a different She'l fucl supplier, which likely would not occur. there is rothing stopping the new operator from re-branding the store. King Evets is clearly tortuously interfering with a contract and business relationship between Catapult Group.
