Akilah Fairman DeKalb County Superior Court Civil Action File No.: 20FM8160-4, Judge Shondeana C. Morris Dear Ms. Fairman: I hope this correspondence finds you doing well. This letter is to inform you of this Firm's intent to withdraw as your counsel from the above- referenced case due to your failure to pay the fees incurred. Enclosed are copies of the necessary documents for our formal withdrawal from your case. This office will file this Motion for Withdrawal on today, March 3, 2023 with your Wavier and you can expect to receive the signed Order from this office as soon as it is executed and filed by the Judge. Under our Court Rules, I am required to notify you of certain information. As soon as the judge signs an order permitting our withdrawal from your case, you will have the burden of keeping the Court informed of where to send notices, pleadings, or other papers to you pertaining to your case. The Rules state that notices and other papers may be served upon you at your last known address and e-mail address, which I am required to provide the Court with in my Motion for Withdrawal as your Counsel pursuant to Uniform Superior Court Rule 4.3. It is vitally important that you keep the Court informed of your whereabouts so that you will be informed of proceedings in your case. You have the obligation to prepare for trial or hire other counsel to prepare for trial ONCE THE ORDER permitting withdrawal from your case is granted. If you fail or refuse to meet this burden, you may suffer adverse consequences, including dismissal of your case. I must further inform you that my withdrawal as counsel will not affect the scheduling or the actual occurrence of any and all proceedings, which may be scheduled, including trial, and you will be further responsible for hiring new counsel to represent you at those proceedings, if you desire. Very truly yours, E. Noreen Banks-Ware E. Noreen Banks-Ware, Esq. //djs/dw Enclosures
