TO THE HONORABLE COURT:
Plaintiff Dongxiao Yue ("Plaintiff")’s process server, Henrietta Seyue, personally served
the Summons and Complaint of this case on Defendants Miao and Bian-wang.com on January 17,
2018 in Columbia, South Carolina. Ms. Seyue promptly mailed Plaintiff a notarized Affidavit of
Service. Plaintiff then requested Ms. Seyue to use the California Proof of Service of SummonsCOI DAA Bw NH HE

form (POS-010). Additional delays were caused by missing signing dates on the proofs. Attached
Exhibit A is a true copy of the proofs of service.
Meanwhile, on February 20, 2018, Defendants filed a notice of removal in the federal
district court for the Northern District of California under 28 U.S. Code § 1441. See Exhibit B for
the docket sheet for the removed case. Under 28 U.S. Code § 1446, “Promptly after the filing of
such notice of removal of a civil action the defendant or defendants shall give written notice
thereof to all adverse parties and shall file a copy of the notice with the clerk of such State court,
which shall effect the removal and the State court shall proceed no further unless and until the case
is remanded.” Apparently, Defendants have failed to file the removal notice with this Court.
Plaintiff has filed a motion in federal court to remand the case back to this Court. The
hearing of that motion is set to May 10, 2018. Plaintiff will report to this Court of the outcome of
that motion once a decision is made by the presiding Magistrate Judge.

Charles Treat TO THE HONORABLE COURT: Plaintiff Dongxiao Yue ("Plaintiff")’s process server, Henrietta Seyue, personally served the Summons and Complaint of this case on Defendants Miao and Bian-wang.com on January 17, 2018 in Columbia, South Carolina. Ms. Seyue promptly mailed Plaintiff a notarized Affidavit of Service. Plaintiff then requested Ms. Seyue to use the California Proof of Service of SummonsCOI DAA Bw NH HE Yb NR YP YP YP NY RY Ye Be ee _ SA AA EROS fF F OCD KRARERAOS form (POS-010). Additional delays were caused by missing signing dates on the proofs. Attached Exhibit A is a true copy of the proofs of service. Meanwhile, on February 20, 2018, Defendants filed a notice of removal in the federal district court for the Northern District of California under 28 U.S. Code § 1441. See Exhibit B for the docket sheet for the removed case. Under 28 U.S. Code § 1446, “Promptly after the filing of such notice of removal of a civil action the defendant or defendants shall give written notice thereof to all adverse parties and shall file a copy of the notice with the clerk of such State court, which shall effect the removal and the State court shall proceed no further unless and until the case is remanded.” Apparently, Defendants have failed to file the removal notice with this Court. Plaintiff has filed a motion in federal court to remand the case back to this Court. The hearing of that motion is set to May 10, 2018.
