Dear Judge,
I am the attorney representing the Plaintiffs in the above referenced matter.
Unfortunately I wish to advise the court and my adversary that one of the named Plaintiffs’,
Liaqat Khan, has passed away. He died without a will and the other named Plaintiffs are the
only heirs and Under CPLR 1015 (b) I believe this matter my proceed. I do not believe that the
estate has been submitted for administration yet. Due to the inordinate amount of time involved
in obtaining Orders from the Kings County Surrogate and in accordance with CPLR 1015(b) we
would like permission to proceed with this matter.
