WHEREAS, on November 28, 2022, plaintiff Cheri Pierson (“Plaintiff”) commenced this
action by filing a Summons and Complaint (NYSCEF Doc. No. 1);
WHEREAS, on February 1, 2023, defendant Leon Black (“Defendant”) filed a Motion to
Dismiss, pursuant to CPLR 3211(a)(7) (NYSCEF Doc. No. 71, Mot. Seq. No. 4) (the “Motion to
Dismiss”), which motion is returnable on February 17, 2023, and Plaintiff’s opposition papers
thereto are due on or before February 10, 2023.
WHEREAS, on December 16, 2022, defendant Leon Black (“Defendant”) filed his Motion
for Sanctions, pursuant to 22 NYCRR §130-1.1 (the “Motion for Sanctions”) (NYSCEF Doc. No.
10, Mot. Seq. No. 1);
WHEREAS, on December 28, 2022, Plaintiff filed a Cross-Motion for Sanctions
(NYSCEF Doc. No. 39, Mot. Seq. No. 1);
WHEREAS, on January 11, 2023, the Court scheduled oral argument on Defendant’s
Motion for Sanctions and Plaintiff’s Cross-Motion for Sanctions for February 23, 2023, at 10:00
a.m. in Part 39, 111 Centre Street, Room 623, New York, NY 10013 (Mot. Seq. No. 1);

NOW THEREFORE, the parties hereby stipulate and agree that:
1. The return date on Defendant Leon Black’s Motion to Dismiss (Dkt. No. 71, the
“Motion to Dismiss”) is extended to Monday, April 3, 2023, in the Motions Submissions Part,
Room 130;
2. The deadline for Plaintiff’s Opposition to Defendant’s Motion to Dismiss is
extended until Wednesday, March 15, 2023; and
3. The deadline for Defendant’s Reply in support of his Motion to Dismiss is extended
until March 31, 2023;
4. The parties jointly request that oral argument on Defendant’s Motion for Sanctions
and Plaintiff’s Cross-Motion for Sanctions (NYSCEF Doc. No. 10, Mot. Seq. No. 1), currently
scheduled for February 23, 2023, be adjourned to April 20, 2023, or a date thereafter at the Court’s
convenience.
IT IS FURTHER STIPULATED AND AGREED that this Stipulation may be executed in
counterparts; and facsimile signatures are deemed original.
