PRESTON J. DOUGLAS an attorney admitted to practice law in the State of New York
affirms under the penalty of perjury:
I am a partner at the firm of GURFEIN DOUGLAS LLP, attorneys for the plaintiffs in the
above-captioned action, and as such am fully familiar with the facts and circumstances surrounding
the action.
A Final Pre-Conference Order (Ex. A) was issued by this court setting a Note of Issue date
on or before March 29, 2020. A Compliance Conference was scheduled for December 10, 2021,
and our office advised the Court on December 9, 2021 that the plaintiff, Ansel Johnson, died in
August 2021. We asked that the Court adjourn the Note of Issue date for six months. (Ex. B).
On May 12, 2022, an Order (Ex. C) was issued by this Court substituting Kirk Johnson as
Administrator of the Estate, and amending the caption.
We were unable to file a Note of Issue until we received a Decision on a pending motion
(#3), which Decision was received September 8, 2022. (Ex. D).
