PLEASE TAKE NOTICE, that the defendants/third-party plaintiffs, MAC 60 LLC and
ROYAL HOME IMPROVEMENTS, INC., by and through their attorneys, KIERNAN
TREBACH LLP, set forth the following as and for their response to plaintiff’s demand for
Expert Witness Disclosure pursuant to CPLR §3101(d) as follows:
1. Identity of Expert:
Defendants/third-party plaintiffs, MAC 60 LLC and ROYAL HOME
IMPROVEMENTS, INC., intend and reserve the right to call William Barr, Ph.D., to testify at
trial in the above matter as a specialist/expert witness in Neuropsychology.
2. Qualifications:
Dr. Barr is Board Certified in Clinical Neuropsychology and holds a PH.D in Clinical
Psychology. His qualifications, educational background and professional background are

embodied in his Curriculum Vitae. A copy of Dr. Barr’s Curriculum Vitae is annexed hereto as
Exhibit “A”.
3. Subject Matter of Testimony:
The subject matter upon which Dr. Barr is expected to testify will include, but not limited
to, plaintiff’s alleged personal injuries, treatment, physical condition, the effects plaintiff’s
alleged injuries have had, and the issues of causation regarding plaintiff’s alleged injuries, his
independent review, examination, findings, and opinions with respect to plaintiff’s allegations of
injury related to the above referenced matter. Dr. Barr is also expected to testify and offer
opinions as to plaintiff’s diagnosis, prognosis and causal relation, if any, between his findings,
injuries and damages alleged by plaintiff related to the above referenced matter. Dr. Barr may
also testify as to his opinions with regard to his findings upon a physical examination of the
plaintiff, review of plaintiff’s medical records and diagnostic films, as well as his opinions
regarding the plaintiff’s pre-existing conditions, the absence of causation, current state of
physical health, disability, the necessity of treatment or lack thereof, and if any, future treatment
is or is not necessary. He may also further testify in response to and/or in rebuttal of any lay or
expert witness testimony adduced at the time of trial and any evidence submitted at the time of
trial.
4. Substance of Facts and Opinions Upon Which Expert Witness Will Testify:
Dr. Barr will testify with regards to his independent neuropsychology examination and
review of plaintiff Antonio Espinosa performed on January 12, 2022. The facts relied upon, his
findings, conclusions and opinions to which Dr. Barr is expected to testify regarding this matter
are set forth in his report dated February 24, 2022 which is annexed hereto as “Exhibit B.” He
may also testify as to his opinions with regard to his findings upon physical examination and
interview of plaintiff, a review of plaintiff’s medical records and reports, any diagnostic films,

and discovery exchanged in this matter, as well as his opinions regarding any pre-existing
conditions, causation, current state of plaintiff’s physical health, disability and future care, if any,
prognosis and diagnosis. The expert may also testify in response to and/or in rebuttal of any lay
or expert witness testimony adduced at the time of trial and any evidence submitted at the time of
trial. Dr. Barr will base his opinions on his examination of plaintiff, review of pertinent medical
care and treatment records, reports and diagnostic films of plaintiff, and discovery exchanged in
this matter. Dr. Barr will also rely upon all available pleadings, examinations before trial
transcripts, medical records and pertinent literature on the subject, as well as his education,
background, training, experience, expertise, knowledge and analysis generally, and in his area of
concentration, neuropsychology and upon any and all testimony and evidence introduced at the
time of the trial of this action.
Dr. Barr is expected to testify as to the nature and extent of plaintiff’s alleged injuries,
including causation; the lack of permanency and limitation alleged, if any; and the lack of actual,
serious or significant injury alleged, if any. Dr. Barr will testify consistent with his report; the
substance and facts upon which Dr. Barr will testify and will base his opinions and testimony
include but are not limited to the following: the details of the physical examination of plaintiff,
as outlined in the expert’s report annexed hereto; his review of the pleadings; plaintiff’s
deposition testimony; discovery; expert reports exchanged by parties to the litigation; and other
documents relative to the lawsuit commenced by plaintiff. Dr. Barr’s testimony will be further
based upon his examination of plaintiff; plaintiff’s medical records, including but not limited to
reports; handwritten notes; diagnostic testing and records; the hospital records from any and all
hospitals, clinics or treatment centers and/or any other facilities of any kind, including, but not
limited to treatment records from plaintiff’s treating and/or examining physicians, all medical
providers’ records and reports of examinations, diagnoses, and treatments; records from

plaintiff’s employer as to all matters which impact upon the condition of the plaintiff; statements
and records from any source; and records from any medical personnel connected with plaintiff’s
pre-accident medical care as it may relate to the nature, extent, and duration of the conditions
and/or disability alleged in the present action; as well as his review of Bill of Particulars; medical
records; radiology studies and films; plaintiff’s deposition testimony; expert disclosures
exchanged by the parties; trial evidence; trial testimony and other material generally relied upon
in formulating opinions, and relevant to his findings relating to the injuries that plaintiff
allegedly sustained on January 11, 2018; test results; reports and notes of consultations with
other physicians and medical personnel; notes, records and reports of attending and/or assisting
physicians and medical personnel; evidence of medications taken, prescribed, refused or
otherwise not taken and the significance and consequences thereof, if any; and any and all other
documents, films, samples, models, reports, notes, records, photographs, testimony, or anything
else which may be introduced into evidence at the time of the trial of this action normally relied
upon by neuropsychology practitioners in the treatment, diagnosis, prognosis, or to form any
opinion with respect to the condition alleged by plaintiff; and any additional records which may
be produced prior to or at the time of trial. Dr. Barr’s testimony will also be based upon
accepted treaties, text, references guides, generally accepted theories relied upon by
neuropsychology experts and his professional and education experience.
5. Summary of Grounds for Expert’s Opinions
Dr. Barr’s anticipated testimony will be based on his education, experience, review of
discovery exchanged in this action, pleadings, deposition testimony, testimonial evidence,
adduced at trial, medical records of the plaintiff, photographs, physician/hospital records and/or
reports concerning the plaintiff, diagnostic tests and films concerning the plaintiff, scientific
literature and studies, guidelines and his expertise in the field of clinical neuropsychology. Dr.

Barr may also rely on tests, research studies, articles, experiments and/or reports with which he is
familiar, and effects plaintiff’s alleged injuries have had; and other material generally relied upon
in formulating relevant impressions, opinions, and conclusions as to plaintiff’s alleged injuries,
as well as any and all testimony and evidence introduced at the time of the trial of this action.
Additionally, his testimony will be further encompassed on materials, evaluations and records
generated and served following his independent examination and review of plaintiff which is
annexed hereto as “Exhibit B.”
6. It is also expected that Dr. Barr will testify in rebuttal to plaintiff’s expert(s).
PLEASE TAKE FURTHER NOTICE that pursuant to CPLR §3101(h),
defendants/third-party plaintiffs, MAC 60 LLC and ROYAL HOME IMPROVEMENTS, INC.,
reserve their right to modify, supplement and/or amend this response, up to and including the
time of trial.
