Now comes the Petitioner, Sean Ohlin, by and through undersigned Counsel, pursuant to
the Ohio Revised Code Sections 119.07 and 119.12, hereby submits his Notice of Appeal from
Disqualification and Notice of Suspension from the Ohio Department of Public Safety, Bureau of
Motor Vehicles dated December 15, 2021 and January 19, 2022, respectively.
For Cause, Counsel submits that the Notice of Disqualification and Notice of Suspension
are not supported by reliable, probative, and substantial evidence and are not in accordance with
the law. The following Exhibits are attached hereto and incorporated herein:

2022 CV 00171To date, Sean Ohlin has not sustained a conviction on his record of any kind. Either the
BMV has confused Mr. Ohlin with another citizen residing within the State of Ohio or the BMV
has misinterpreted the laws of the State of Ohio to such an extent that driver license suspensions
are being imposed without factual or legal justification. If the misinterpretation is based on an
error submitted by the foreign jurisdiction—Pennsylvania—then certainly an Ohio citizen cannot
be held hostage because administrative agencies are uncertain of what constitutes a “conviction”,

Good afternoon Mr. Mack. Thank you for the email and the update regarding
Mr. Ohlin’s personal license status, as well as his commercial license status as it
pertains to the Ohio BMV. Your email states that “...the BMV received notice
of an OVI conviction from the state of Pennsylvania”. Could you provide me
with the Notice the BMV received from Pennsylvania? Because unfortunately,
it appears that there still remains somewhat of a disconnect between what has
been received by you, or reported to you, by Pennsylvania. I’m not sure if the
confusion in the translation is on the sending end or on the receiving end. Let
me explain Mr. Ohlin’s situation...
On July 9, 2021, Jefferson Township PD in Mercer County, PA, filed a criminal
complaint against Mr. Ohlin, The complaint was based upon an allegation of
DUI in Pennsylvania. The Court process and procedure took place, and all
court proceedings concluded on November 30, 2022. Also on November 30,
2022, and as a result those court proceedings concluding, Mr, Ohlin began a
pretrial diversion program known in Pennsylvania as Accelerated Rehabilitative
Disposition (ARD).
Accelerated Rehabilitative Disposition (ARD) is under a Pennsylvania law that
allows certain individuals that have been charged with certain charges to
complete a period of supervision and to have their charges dismissed, ARD
exists for both DUI cases and non-DUI cases. Part of ARD for DUI cases is

Pennsylvania, is suspended based upon the underlying factual allegation of the
particular individual’s blood alcohol content. ARD is not an adjudication of
any type of guilt. ARD is not a conviction of any kind. Most importantly for
the purposes our discussion, the administrative suspension imposed by

information that Mr. Ohlin sustained a DUI conviction. That is not true. It also
appears that PENNDOT has administratively sent you information that Mr.
Ohlin sustained a suspension of his privilege to drive a motor vehicle in
Pennsylvania as a result of a DUI conviction. That is not true. In fact, if you
were to look up Mr. Ohlin’s case on the public access system for the
Commonwealth of Pennsylvania, you would find that his case is in a holding
pattem based on being allowed to participate in ARD, and that there is no
conviction or adjudication of any kind,
It appears that you, or your office, has relied on whatever information you have
received from PENNDOT in applying a suspension against Mr. Ohlin’s
personal and commercial driver licenses. It also appears that your reliance is
based on the notion that Mr. Ohlin sustained a DUI conviction, and subsequent
license suspension as a result of a DUI conviction. That is inaccurate in both
the information sent to you and also in the manner of interpretation from
whatever PENNDOT sent to you. Pursuant to the Ohio BMV, Mr. Ohlin’s
personal and commercial licenses have sustained suspensions based upon an
equivalent OVI conviction from Pennsylvania. For the reasons herein
discussed, that is erroneous across the board.
1 understand that your hands may be tied with regard to your ability not to apply
a suspension to Mr. Ohlin. However, for purposes of preserving the time for
appeal to our local Common Pleas Court, will your written decision be sent to
Mr. Ohlin, to me as Attorney of record, or to both of us? Again, thank you very

The BMV has received your request for an Administrative
Hearing regarding your client Sean Ohlin and his case
C©521001206. | have reviewed the matter and | don't believe a
hearing is necessary at this time. | amended the suspension
dates for this case to match the dates imposed by the state of
Pennsylvania. His case now runs from 1/18/2022 through
2/17/2022. With the case amended to only a 30-day suspension,
the $40 reinstatement fee was also removed and this case will
close out on 2/17/2022.
Mr. Onlin is also a CDL holder. Because the BMV received notice
of an OVI conviction from the state of Pennsylvania, a one-year
disqualification has also been imposed. Unfortunately, those
dates cannot be amended and will run from 1/19/2022 -
1/19/2023. This only affects his ability to operate a CMV. After
2/17/2022, he will again be able to operate non-commercial
vehicles.

Thank you for the email and the update regarding Mr. Ohlin’s personal license status, as well as his commercial license status as it pertains to the Ohio BMV. Your email states that “...the BMV received notice of an OVI conviction from the state of Pennsylvania”. Could you provide me with the Notice the BMV received from Pennsylvania? Because unfortunately, it appears that there still remains somewhat of a disconnect between what has been received by you, or reported to you, by Pennsylvania. I’m not sure if the confusion in the translation is on the sending end or on the receiving end. Let me explain Mr. Ohlin’s situation... On July 9, 2021, Jefferson Township PD in Mercer County, PA, filed a criminal complaint against Mr. Ohlin, The complaint was based upon an allegation of DUI in Pennsylvania. The Court process and procedure took place, and all court proceedings concluded on November 30, 2022. Also on November 30, 2022, and as a result those court proceedings concluding, Mr, Ohlin began a pretrial diversion program known in Pennsylvania as Accelerated Rehabilitative Disposition (ARD). Accelerated Rehabilitative Disposition (ARD) is under a Pennsylvania law that allows certain individuals that have been charged with certain charges to complete a period of supervision and to have their charges dismissed, ARD exists for both DUI cases and non-DUI cases. Part of ARD for DUI cases is that a Pennsylvania resident’s license, or non-resident privilege to drive in Pennsylvania, is suspended based upon the underlying factual allegation of the particular individual’s blood alcohol content. ARD is not an adjudication of any type of guilt. ARD is not a conviction of any kind. Most importantly for the purposes our discussion, the administrative suspension imposed by PENNDOT — IS NOT IMPOSED BASED UPON A CONVICTION OF ANY KIND. It also appears that PENNDOT has administratively sent you information that Mr. Ohlin sustained a suspension of his privilege to drive a motor vehicle in Pennsylvania as a result of a DUI conviction. That is not true. In fact, if you were to look up Mr. Ohlin’s case on the public access system for the Commonwealth of Pennsylvania, you would find that his case is in a holding pattem based on being allowed to participate in ARD, and that there is no conviction or adjudication of any kind, It appears that you, or your office, has relied on whatever information you have received from PENNDOT in applying a suspension against Mr. Ohlin’s personal and commercial driver licenses. It also appears that your reliance is based on the notion that Mr. Ohlin sustained a DUI conviction, and subsequent license suspension as a result of a DUI conviction. That is inaccurate in both the information sent to you and also in the manner of interpretation from whatever PENNDOT sent to you. Pursuant to the Ohio BMV, Mr. Ohlin’s personal and commercial licenses have sustained suspensions based upon an equivalent OVI conviction from Pennsylvania. For the reasons herein discussed, that is erroneous across the board. 1 understand that your hands may be tied with regard to your ability not to apply a suspension to Mr. Ohlin.
