MOTION FOR ORDER DIRECTING CLERK TO ISSUE
CERTIFICATE OF TITLE
NOW COMES Plaintiff, FIRST LIDO CONDOMINIUM, INC., by and through its
undersigned counsel, and requests this Court to enter an Order directing Clerk to Issue the Certificate
of Title:
l. The Plaintiff commenced this action on August 22, 2014 and a Final Summary
Judgment of Foreclosure was entered more than three years ago on March 31, 2015.
2. The Defendant thereafter filed numerous suggestions of Bankruptcy resulting in
canceling the foreclosure sale on multiple occasions.
3. The property was sold to a third party on December 12, 2018. A copy of the Certificate
of Sale issued on December 12, 2018 is attached as Exhibit “1” hereto.
4, On December 21, 2018 at 05:36:50 p.m., Defendant, Clo-Ann Garrison filed
Defendants Objection to Issuance of Title and Motion to Set Aside and Vacate Foreclosure Sale.
5. Assessments and charges due and owing to the Association continue to accrue monthly
during the pendency of this matter further damaging the Association.
6. Pursuant to Section 718.116, Florida Statutes, the Association is entitled to recover the
balance of all unpaid assessments from the new owner upon transfer of title.

connection with the sale of the subject property and for such other and further relief as this Court deems
appropriate,
