                      Mark   H. Stein,  Esq,  being  duly  sworn   says:




                               I am the  attorney  for the  Plaintiffand  as such, I have  knowledge   of the facts and
                      circumstances    surrounding   this action.  I am making   thisaffidavit pursuant   to CCM-186.


                               Based  upon   information   and  belief,the original  creditor, FirstNational  Bank  Of Omaha,
                      a subsidiary  of First National   of Nebraska,    Inc., a banking  company    with  a State of
                      Incorporation   in Nebraska   , having a statute  of limitations of  5 years for this type of action. The
                      date  of lastpayment    prior to the commencement       of this action was  12/06/2016.    This action was
                      commenced     on 09/18/2017     and  after reasonable   inquiry he has  reason  to believe  the statute  of
                      limitations  has not expired.
