NOTICE IS HEREBY GIVEN that an action has been commenced and is pending in this
Court upon a Summons with Verified Complaint of the above-named Plaintiff against the above-
named Defendant alleging, among other things, claims for breach of an Agreement of Purchase
and Sale, and in the alternative, specific performance, for the 11,500 square-foot Retail Unit at the
FÖRENA Condominium located at 540 Sixth Avenue, New York, New York, designated as Block
816, Lot 1451 on the Official Tax Map of the City of New York, Borough of New York
(hereinafter, the “Retail Unit”).
NOTICE IS HEREBY FURTHER GIVEN that the premises affected by said action was,
at the time of the commencement of this action, and at the time of the filing of this Notice of
Pendency, are located in New York County, State of New York, at 540 Sixth Avenue, the Retail
Unit, New York, New York, designated as Block 816, Lot 1451 on the Official Tax Map of the
City of New York, Borough of New York, and are more particularly described in the “Schedule
A” annexed hereto and made a part hereof.
The Clerk of New York County is directed to index this notice to the name of Defendant,

SCHEDULE A
This Notice of Pendency concerns the 11,500 square-foot Retail Unit at the FÖRENA
Condominium located at 540 Sixth Avenue, New York, New York, designated as Block 816, Lot
1451 on the Official Tax Map of the City of New York, Borough of New York. The Retail Unit is
a condominium retail unit consisting of approximately two (2) floors and containing approximately
6,500 square feet on the ground floor and 5,000 square feet in the cellar level, and totaling 11,500
square feet, including an allocation of the floor area of the common elements. The Retail Unit is
located at the FÖRENA Condominium Building, which has eleven (11) floors and consists of (a)
the Retail Unit (b) approximately ten (10) floors of residential condominium apartments; and (c)
various other condominium units, amenities, facilities and services.
