NO. 160 RECEIVED NYSCEF: 08/30/2022 SUPREME COURT OF THE STATE OF NEW YORK COUNTY OF SUFFOLK Index Number: 26910/12 xxxxxx xxxxxxxx, on behalf of C S , an infant under the age of 18, and xxxxxx xxxxxxxx, PLAINTIFF’S EXPERT Individually, WITNESS EXCHANGE CRANIOFACIAL Plaintiffs, RECONSTRUCTIVE & PLASTIC SURGERY -against- RONALD J. TADEO, M.D., RICHARD PITCH, M.D., SCOTT BERLIN, M.D., SHORE PSYCHIATRIC CENTER, FAMILY PSYCHOLOGY OF LONG ISLAND, BERLIN OBGYN ASSOCIATES, JANSSEN PHARMACEUTICALS, INC. and ZYDUS PHARMACEUTICALS (USA), INC., Defendants. Plaintiffs, by their attorneys, NAPOLI SHKOLNIK PLLC, as and for an Expert Witness Disclosure pursuant to CPLR §3101(d), reserves the right to call the following witness at the time of trial: Russell R. Reid, M.D., Ph.D. The University of Chicago Medical Center 5841 S. Maryland Avenue Chicago, IL 60637 1. Annexed hereto is the curriculum vitae of Russell R. Reid, M.D., Ph.D. which sets out his qualifications, educational background, training, membership in societies, academic appointments and committees and publication and teaching experience. 2. In particular, Dr. Reid is an experienced craniofacial plastic and reconstructive surgeon who is licensed to practice medicine in the state of Illinois. He is board certified by the American Board of Plastic Surgery. He received his medical degree Northwestern University in FILED: SUFFOLK COUNTY CLERK 08/30/2022 03:55 PM INDEX NO. 026910/2012 NYSCEF DOC. NO. 160 RECEIVED NYSCEF: 08/30/2022 1998, where he also earned a Ph.D. in Pathology. He completed his residency and fellowship in Plastic Surgery at the University of Chicago/McGraw Medical Center in 2005. He completed a fellowship in craniofacial surgery at the University of Pennsylvania in 2006. 3. Dr. Reid specializes in the field of pediatric craniofacial reconstructive and plastic surgery. He is a Director of the Cleft Lip and Palate Team and Director of the Laboratory and Director of the Craniofacial Anomalies Multidisciplinary Program both with the University of Chicago Medical Center, where he also serves as a Professor of Surgery and Pediatrics. 4. Dr. Reid is expected to opine at the time of trial, on behalf of infant plaintiff, C S , with regard to the permanent disability of plaintiff, as a result of teratogenic injuries he sustained in utero from Topamax/topiramate, which resulted in a bilateral cleft lip and palate, developmental delays, hearing delays, and severe mental anguish and distress. More particularly, Dr. Reid is expected to testify pertaining to the plaintiff’s physical, ailments, personal injuries with respect to their implications on C craniofacial growth and development, and his need for future treatment including surgery, and how they are all sequelae of the cleft lip and cleft palate C developed in utero. 5. Dr. Reid will opine that due to the subject malpractice, plaintiff, C S , has suffered serious, permanent and debilitating personal injuries, which adversely affect plaintiff’s past, present and future health status and mental health status, which will continue into adulthood and negatively affect quality of life. 6. Dr. Reid will opine in regards to the medical diagnoses and conclusions, relevant to the plaintiff’s health status, as a result of the injuries in utero he sustained which are the subject of this lawsuit. 7. Dr. Reid is expected to opine on how craniofacial defects begin in embryonic FILED: SUFFOLK COUNTY CLERK 08/30/2022 03:55 PM INDEX NO. 026910/2012 NYSCEF DOC. He will testify on how the fetal palate, lips, nose, and jaw develop in the first few weeks of pregnancy, and the effects of teratogens, including Topamax/topiramate, on said development. It is Dr. Reid’s opinion that Topamax/topiramate has the ability to significantly alter the activity of important cell signaling molecules (proteins), which can be translated to the context of the developing embryo. 8. Dr. Reis is expected to opine that C craniofacial malformations, specifically cleft lip palate consistent with· abnormal craniofacial development due to perturbations of select signaling.· pathways during embryogenesis, and that development of the craniofacies requires strict coordination of cellular activity, which is controlled by cell-signaling proteins to regulate cellular communication. He will opine that Topiramate ultimately impairs embryonic cellular differentiation and growth as it is shown to interfere and disrupt these proteins and that such a disruption can lead to the induction of congenital defects. 9. Dr. Reid will opine that craniofacial defects are among the known congenital malformations occurring at a higher prevalence in children exposed to maternal use of topiramate. Oral clefts, particularly cleft lip and. palate, are craniofacial defects known to ·occur due to alteration of the activity of signaling proteins. 10. Dr. Reid will opine that C cleft lip and palate ate consistent with the congenital malformations seen in children born to mothers who ingested Topamax/topiramate during pregnancy. This is supported by the facts that C mother ingested this medication during the first trimester and the lack of other statistically significant comorbidities. 11. Dr. Reid’s opinion is based on his extensive education, knowledge of and expertise in plastic and reconstructive craniofacial surgery, his experience treating children with cleft lips and palates, his academic research on the subject, all medical records relevant in this FILED: SUFFOLK COUNTY CLERK 08/30/2022 03:55 PM INDEX NO. 026910/2012 NYSCEF DOC. Dr. Reid will opine that C S will continue to have permanent deficits that will require medical treatment and procedures for the foreseeable future. 13. Dr. Reid will opine that Topamax/topiramate is causally associated with oral clefts in infants born to mothers who ingest this medication during the first trimester and in particular that C S injuries are of a direct causal relationship the subject malpractice. 14. Dr. Reid will also rebut defendants’ medical expert’s testimony and will comment on any and all evidence and exhibits used at the time of trial. 15.
