Bradley L. Rice, an attorney duly admitted to practice before
the courts of the State of New York, hereby affirms that the
following is true and correct:
1. I am a partner at Nagel Rice, LLP, counsel to Plaintiff
86th STREET LENDER LLP, (“86th Street”) in this matter. I am fully
familiar with the facts and circumstances set forth herein.
2. On May 17, 2022, through the filing of the instant OSC
by NYSCEF, and pursuant to Uniform Civil Rule 202.8-d and 202.8-
e, counsel for petitioner Jardan 520 LLC that 86th Street was
advised that 86th Street would be seeking a stay in the instant
matter pursuant to CPLR §2201.
3. Further, as set forth in the filed Order to Show Cause,
through its electronic filing, 86th Street has provided Petitioner
sufficient time in which to oppose this order to show cause once
the Court fixes the time, date and place that the order to show
cause will be heard.
4. Attached as Exhibit 1 hereto is a true and correct copy
of the March 25, 2022 Settlement Agreements.
