CPLR §§ 5225 (b) and 5227, and Confirmation of Priority Execution Pursuant to CPLR § 5239,
Affirmation of K. Heather Robinson, Esq., Memorandum of Law In Support Relief Under CPLR
§§ 5225 (b) and 5227, and Confirmation of Priority Execution Pursuant to CPLR § 5239,
Request for Judicial Intervention and Notice of Electronic Filing on 86TH STREET LENDER
LLP by delivering and leaving with Richard DiGiovanna, ESQ., an agent of the Secretary of
State, of the State of New York, two (2)true copies thereof and at the time of making such
service deponent paid said Secretary of State a fee of forty dollars. That said service was made
pursuant to section 121-1502 of the Partnership Law.
Deponent further states that he knew the person so served as aforesaid to be the individual on
the Office of the Secretary of State of New York, duly authorized to accept such service on
behalf of the said defendant.
Richard DiGiovanna is a white male, approximately 60 years of age, stands 5 feet 8 inches tall,
