16 name is Gary Vegliante, I am an attorney
17 for the defendant in this action, Mr. Noel
18 Paul. We're here to ask you questions
19 about an accident that occurred in October
20 of 2016. Before we start I just want to
21 lay a couple of ground rules.
22 So first, if at any time you need to
23 take a break it's completely fine just let

22 A. Drywall Tapers Finishing Union.

24 that union?
25 A. Apprentice drywall taper.

3 as an apprentice drywall taper, what kind
4 of stuff would you do on a daily basis?
5 A. We handle deliveries for
6 compound, skids of deliveries, mixed
7 compound for prep and plaster for walls,
8 sand walls for painting.
9 Q. So just it was generally a
10 construction type of job; is that fair to
11 say?
12 A. Correct.
13 Q. And you were working generally on
14 your feet or an active manner not sitting
15 behind a desk?
16 A. Correct.
17 Q. As a result of this accident, did
18 you miss any time from work?
19 A. Yes.
20 Q. How much time approximately did
21 you miss?
22 A. About five months.
23 Q. And during that five months did
24 you receive any sort of income from any
25 source; what I mean by that is did your job

13 in No-Fault benefits for the lost time of
14 work?
15 THE WITNESS: No.
16 Q. That was my next question. You
17 didn't receive any No-Fault benefits?
18 A. No.
19 Q. Did you ever make a Worker's
20 Compensation claim as a result of this
21 accident?
22 A. No.
23 Q. Did you have any type of
24 disability insurance that would pay you any
25 portion of your salary while you were

14 unemployment?
15 A. A month after the accident.
16 Q. And that lasted for the rest of
17 the five months so basically one month
18 after, the next four months or so you
19 received unemployment?
20 A. Correct.
21 Q. And when did you return to work?
22 A. Later on in the year, I would say
23 around late August, early September of
24 2017.

5 A. To my recollection I remember it
6 was two years ago I believe but he said it
7 was 2017 but I just remember we are in '19
8 now so.
9 Q. So when you say two years ago?
10 A. I have the record in my phone, I
11 don't know if it's okay to show y'all.
12 Q. What I will say is that we're
13 here to question you on what you remember
14 from the accident. Now, I have a copy of
15 the police report here, I can tell you the
16 police report states that the accident
17 happened on October 27 of 2016. Now, the
18 police reports are not written in stone, it
19 isn't the law but is that when you remember
20 the accident?
21 A. It could have been yes, because
22 the year before that I was injured as well
23 and that's the day before it happened the
24 prior year so that's correct.

12 or September of 2017. When you returned to
13 work did you return to the Local 1974 or
14 did you start a new job?
15 A. Yes.
16 Q. And what was your job position
17 when you returned?
18 A. The same.
19 Q. Do you still work at Local 1974?
20 A. No.
21 Q. When did you stop working for
22 them?
23 A. Last year, 2018.
24 Q. And for what reason did you stop
25 working?
