I, the undersigned, am counsel for Appellants and hereby move for an
extension of time to pay the filing fee and to designate the record on appeal.
11: Thave conferred with my clients about presenting this request for ~
extensions of time and my clients agree with this request.
2. Iam requesting an extension of time to pay the $775 filing fee and to
designate the record on appeal because the underlying state court case may settle,
pending the outcome of an arbitration before the Honorable William Cahill (Ret.) of
JAMS.
3. The aforesaid arbitration before Judge Cahill will occur on December 2
and 3, 2013. It will certain resolve certain issues, including certain monetary
disputes, that exist between Defendant San Francisco Deputy Sheriffs’ Association,
and Defendants David Wong, Michael Zehner, Brian Savage, Shedrick McDaniels
and the San Francisco Deputy Sheriffs’ Association Foundation. That outcome
should determine, among other things, the amount of financial resources then
available for settlement of the underlying state court matter with appellants. Such a
settlement would obviate the reason for this appeal.
4. If this extension is granted, Appellants will not have to immediately begin
to incur the expenses of attorneys’ fees and court costs, including the $775 filing fee,
that this appeal will require. Otherwise, such expenses would become an additional
factor in the parties’ efforts at settlement of the underlying state court case.
5. Therefore, | respectfully request an extension of time until January 3,
2014, because J believe that such an extension would provide sufficient time for the
December 2 and 3, 2013 arbitration before Judge Cahill to be completed and for
Judge Cahill to render his decision, and, if the underlying state court case does not
then resolve, for appellants to pay the filing fee and designate the record on appeal.
6. I respectfully submit that the foregoing reasons constitute good cause forthe extension of times being requested herein.
