1. Lam an attorney at law duly licensed to practice before all the courts of the State of
California. I know the following facts of my own knowledge and could and would testify to
them in a court of law if called upon to do so. 1 am attomey of record for the Plaintiffs in this
matter.

2. Plaintiffs’ Memorandum of Points and Authorities in Opposition to Demurrer to First
Amended Complaint was timely served on defendants.

3. My office sought to e-file the aforementioned document last week. However the “e-
filing” of the aforementioned document was rejected last week because the proof of service had

requirement.

4. We did not learn until today that the aforementioned document has been rejected for
filing for the foregoing reason.

6. This mistake was entirely inadvertent and | apologize to the Court for it.
