Hines Brittany Kronenberger : WAYNE COUNTY CHILDREN Defendant : SERVICES BOARD'S : RESPONSE TO REQUEST FOR RECORDS Now Comes the, Wayne County Children Services Board (*“WCCSB”) by and through undersigned counsel and files its response for the production of records filed by Father. Ohio Administrative Code § 5101:2-34-38(A) States, “Each report and investigation of alleged child abuse or neglect is confidential and may be shared only when dissemination is authorized by this rule.” None of the identified reasons for dissemination are applicable in this case. Ohio Admin. Code § 5101:2-34-38. The records that are being requested are also confidential pursuant to R.C. § 5153.17. Further, this information cannot be released because it is protected by R.C. § 2151.421(H)(2). Violators can be charged with a fourth degree misdemeanor under R.C. § 2151.99. Wherefore, the Children Services Board respectfully requests the Court to quash the issued subpoena or in the alternative. to order an in camera inspection by the judge or magistrate prior to the release of the record. Should the Court determine that certain information from Child Services Board's records should be released, Wayne County Children Services Board requests the following conditions of release: 1.) No copies of the records be given to any parties and/or their attorneys.2) 3) 4) + Any review take place on Court premises. Individuals permitted to review the records should limit their review to reading and note taking and that no photographing, reading into a tape recorder, or copying be allowed. Should the parties* attorneys be permitted to copy portions of the records, such copies be returned to the Court at the conclusion of the proceeding for which the information is to be used.
