"IN THE COURT OF COMMON PLEAS
DOMESTIC RELATIONS
CLERK OF COURTS WAYNE COUNTY, OHIO
TIMOTHY KRONENBERGER ) CASE NO. 09-DR-0222
Plaintiff ) Judge Robert J. Brown
Magistrate Robert B. Hines
BRITTANY KRONENBERGER , MOTION FOR RELIEF
Defendant ,
)
Now comes the Defendant, Brittany Kronenberger, by and through her undersigned
attorney, and hereby moves the court for the following order:
1) An order requiring the minor child herein, Taylor Kronenberger, to continue to
be enrolled in the Green Local School District, and more specifically to
continue to attend Smithville Elementary, even though visitation between
Plaintiff, the residential parent for school purposes, and the minor child has been
suspended until further hearing by this court.
Ms. Kronenberger has been forced to request such an order as the Green Local School
District is threatening to kick the minor child out of the district and her elementary school.
The Court held a hearing on August 9, 2010 to determine which party should be
designated the residential parent for school purposes of the minor children, Taylor
Kronenberger and Tori Kronenberger. The Court held, at the conclusion of that hearing, that
Mr. Kronenberger should be designated residential parent for school purposes given the travel
time and logistics of getting the children to their appropriate school or daycare provider.Shriner

Shortly thereafter, Taylor Kronenberger began kindergarten at Smithville Elementary in
the Green Local School District. She has continued attending the same.
On August 23, 2010 the visitation between Mr. Kronenberger and minor child was
temporarily suspended. The suspension order continues at this time.
Due to the suspension of Defendant’s visitation, the Green Local Schoo! District is
threatening to cease Taylor’s enrollment in their school district as they have no paperwork that
requires the child to continue to be enrolled in Green Local School District or in Smithville
Elementary School. The School District has conveyed to Ms. Kronenberger that it considers
her to be the residential parent of the children and since she does not reside in the school
district, Taylor is not permitted to continue to attend their elementary school unless court
ordered.
Ms. Kronenberger does not believe it is in Taylor’s best interest to transfer elementary
schools at this time. Although she originally did not want the child to attend Green Local
Schools, she believes it will be disruptive and unfair to the child to have to transfer elementary |
schools at this time.
Therefore she is requesting the Court order Taylor Kronenberger continue to
be enrolled in the Green Local School District, and more specifically continue to attend
Smithville Elementary, even though visitation between Plaintiff, the residential parent for
school purposes, and the minor child has been suspended until further hearing by the Court.y y
