MEHMET GOKCE, ESQ., an attorney duly admitted to practice law before the Courts
of the State of New York, herein affirms the truth of the following, upon information and belief,
under penalties of perjury.
1. I am counsel for the Defendant in the above captioned matter and am familiar with all the
facts and circumstances as herein set forth.
2. On November 9d',2022, when the above-captioned matter is scheduled, I am unable to
appear because I am actually engaged in Index No. 508949/2017, MICHELLE
WINDHAM v. OCTAVIO CAMPOVERDE as attorney for the Defendant. The matter is
currently scheduled for trial.
3. I was assigned to pick a jury on October 31st, 2022 but I was not given a panel until
November 2nd, 2022. We finished selecting our jury and are awaiting a judge to be assigned
the case. The backlog of cases waiting for judges has been between 5-10 days. There is
therefore no conceivable way for me to be able to appear for the November 9 jury selection
date. This delay in jury panels and judge assignments was unpredictable and completely
unusual in Kings County, Supreme Court where I have practiced for several years.

4. It isrespectfully submitted that MICHELLE WINDHAM v. OCTAVIO CAMPOVERDE
has priority over the above captioned matter, pursuant to 22 NYCRR § 125.1

which allparties and counsel are available and convenient to the Court, on which I am also
