outright vacating the trial date pending the appeals of the criminally convicted defendants.

Despite providing the Summons and Second Amended Complaint for service on newly

2 ||named defendant DAVID REPLOGLE, Commonwealth has still not received confirmation of
3 || service and a proof of service from Mr. REPLOGLE’s current custodian at the California
4 || Substance Abuse Treatment Facility and State Prison at Corcoran, California — Mr.
5 || REPLOGLE’s current location. Once that service is confirmed, Commonwealth will proceed
6 || with discovery of Mr. REPLOGLE.
7 Commonwealth respectfully asks that this Court, pursuant to California Rules of Court,
8 || Rule 3.1332(c)(5)(B), grant the requested continuance of the trial date (to a date no earlier than
9 || September 22, 2014), or, alternatively, that this Court vacate the trial date pending the criminal

10 || appeals relevant to several of the defendants.
