Please allow this correspondence to serve as further follow-up to our conversations with the Court and all
counsel at the Court conference held on February 20, 2020, as well as in anticipation of our upcoming conference
with the Court, with regard to the above-referenced matter.
Enclosed are my clients’ demands, directed to each individual plaintiff, for a verified bill of particulars,
omnibus discovery demands, demands for Medicare information and/or Medicaid Lien information, Notices to
Produce, and updated EBT notices for each named plaintiff. Please let this serve as our request that you agree to
accept service of these discovery demands via e-mail only due to the COVID-19 pandemic and upon receipt of
this correspondence, please confirm your agreement to accept service of same via e-mail only.
As you know, at the time of the February 20, 2020 conference, we specifically requested that your office
provide us with entire, complete, and full copies of any and all documentation, records, charts, notes, memoranda,
and medical reports with respect to each of the seven (7) named plaintiffs/plaintiffs’ decedents obtained by your
clients from the defendant facilities. This demand is more formally contained in Notices to Produce, addressed
to each individual plaintiff, enclosed with this correspondence. Please let this confirm that we have received the
information, documentation, and records that you provided our office on June 15, 2020, in response to this request.
We are in the process of reviewing and evaluating the information, documentation, and records that you provided.

Significantly, please be advised that the defendants expressly reserve their right to serve further discovery
demands that may be necessary for the defense of this matter including, but not limited to, pre-certification
discovery and post-certification discovery should the plaintiffs’ motion seeking class certification be successful.
Additionally, at the time of the February conference, you advised of your intention to evaluate the prior
discovery demands served by plaintiffs in this case and consider revising or replacing same to be consistent with
Justice NeMoyer’s decision in Passucci v. Absolut Center for Nursing and Rehabilitation, etc., et al., which limits
the scope of the proposed class action period as to each of the defendant facilities to the actual dates the seven (7)
named plaintiffs/plaintiffs’ decedents were residents of those facilities. Please let this serve as our further request
that you provide us with a revised plaintiffs’ Fifth Notice to Produce limiting the scope of discovery to be
consistent with Justice NeMoyer’s decision in the Passucci matter.
In response to your advisement that you are unable to locate my clients’ responses to plaintiffs’ First,
Second, Third, and Fourth Notices to Produce, I enclose copies of our written responses and ask that you advise
whether you wish our office to resend the attachments to those responses.
Finally, please provide us with copies of any new filings relative to the separate Stevens action and advise
us if an appearance is entered by an attorney on behalf of our client, W. Richard Zacher.
