IMPORTANT NOTICE
For your information, the appeal to the Superior Court shall consist of a new hearing. If the appeal is from
the judgment rendered in the Small Claims Court, the scope of the hearing shall include the claims of all
parties who were parties to the small claims action at the time the notice of appeal was filed.
If the appeal is from the denial of a motion to vacate the judgment of the Small Claims Court and the
Superior Court determines that the motion to vacate should have been granted, the Superior Court may
hear the claims of all parties without rescheduling the matter provided all parties are present or may order
the case transferred to the Small claims Court for a hearing.
Both parties are entitled to be represented by an attorney if they wish. Although it is not necessary that
you be represented by an attorney, you should be aware that the other side may appear with an attorney
who may make certain legal objections at the hearing which were not made at the original Small Claims
trial. If you choose to appear without an attorney, you will be expected to represent yourself at all stages
of the proceedings and should not expect the Bench Officer who is presiding to act as your attorney.
It is important that you have all necessary witnesses physically present at the hearing to testify. You
may subpoena any necessary witnesses and documents and may obtain the appropriate subpoena forms
from this office.
A copy of the judgment rendered by the Superior court will be mailed to you following the hearing. Please
keep the Clerk of the court informed of your current address and telephone number.
THE JUDGMENT OF THE SUPERIOR COURT IS FINAL AND NOT APPEALABLE.
