The matter arose from the Plaintiff's allegations that Grand Slam Ventures, LLC, its employees, servants, representatives, agents, contractors, subcontractors and/or assigns illegally, improperly, extrajudicially, forcibly and intentionally broke into the premises located at 219 Hempstead Turnpike, West Hempstead, New York 11552 and removed Plaintiff's personal property therefrom without the Plaintiffs ·,' \ consent or a court order allowing them to do so. Plaintiff sought treble damages pursuant to RPAPL §853, and that punitive damages are warranted because the actions by Grand Slam Ventures, LLC were willful, wanton and in reckless disregard to the Plaintiff's rights. By Order of the Court dated February 17, 2016 Plaintiff was granted a default judgment as to the issue of liability and the matter was set down for an inquest to determine Plaintiff's damages. On June 16, 2016 Defendant Grand Slam presented an Order Show Cause seeking to open the default judgment, vacate the Note of Issue and to interpose a Notice of Appearance and Deinand for a Complaint and by Order dated September 15, 2016 the Court held, inter alia, "[t]he Court determines the defendant satisfies its burden under CPLR 317." On Plaintiffs appeal, the Appellate Division, Second Department, by Decision and Order dated April 25, 2018, reversed the Court's September 15, 2016 decision and denied defendant Grand Slam Ventures, LLC's motion.
