FILED: NASSAU COUNTY CLERK 11/09/2022 05:02 PM INDEX NO. 602826/2022 NYSCEF DOC. NO. 98 RECEIVED NYSCEF: 11/09/2022 IN THE DISTRICT COURT OF APPEAL OF THE STATE OF FLORIDA FOURTH DISTRICT, 110 SOUTH TAMARIND AVENUE, WEST PALM BEACH, FL 33401 June 21, 2022 CASE NO.: 4D22-1583 L.T. No.: 502020CA012935 ATLAS CYBERSECURITY, LLC, DACS v. BEN-ZION ALCALAY, et al. CYBERSECURITY HOLDINGS, LLC and BARRY DYNKIN Appellant / Petitioner(s) Appellee / Respondent(s) BY ORDER OF THE COURT: ORDERED that, within ten (10) days from the date of this order, appellants shall file in this court a brief statement explaining the basis for this court’s subject matter jurisdiction over the order appealed in this case, citing supporting legal authorities. Appellants shall specifically address how the underlying motion to vacate was authorized, as it appears to have been directed towards a nonfinal order granting judgment in favor of the plaintiff. See Fla. R. App. P. 9.130(a)(5); Caufield v. Cantele, 837 So. 2d 371, 375 (Fla. 2002) ("A final judgment is one which ends the litigation between the parties and disposes of all issues involved such that no further action by the court will be necessary."); Malu v. City of Gainesville, 872 So. 2d 445 (Fla. 1st DCA 2004) ("A determination that 'final judgment shall be entered,' is insufficient to unequivocally demonstrate finality."); Bennett's Leasing, Inc. v. First St. Mortg. Corp., 870 So. 2d 93, 97 (Fla. 1st DCA 2003) (explaining that a motion to vacate must be directed towards a final order in order to be authorized). Further, Appellee may file a response within ten (10) days of service of that statement. Served: cc: Gary Charles Rosen Jonathan M. Davidoff ct
