sive this Affidavit. The thets contained in this Affidavit are based upon my personal knowledge,
jnformation and belief, The fuots set firth inthis Affidavit are true und correct to the best of my
knowledge. ‘Wéswom as a witness, 1 could testify competently to the.facts contained herein,
2. was.employed by Union Carbide Corporation (“Union Catbide") from 1951 to.
1985, During ny career working for Union Carbide, 1 served in several different capacities, 1
became involved In Union Carbide’s asbestos group in Niagara Falls, New York in 1966. From -
1967 to 1970, 1 was technical superintendent at the King City wiine and mill in King City,
Colifornia at which Union Carbide’s Calida ashestos ‘wis mined and processed, respectively.
From 1970 to 1981, T served a3 Marketing Manager for the Union Carbide Calidria asbestos

asbestos opértions, 1 served in thls eapacity unl Union Carbide sold its asbestos business it
1985. As a result of my years. of experience with Union Carbide’s asbestos business, T am
famfliar swith the various applications and uses of Union Cathide’s Calidria ashestos, By virtue
of my position with Union Carbide, [ bed siestings with Union Carbide’s customers and
repulatly reviewed reporis vaitten by Calidvia satesrnen that sumamarized meetings with Union
: Carbide customezs.
4, Union Carbide began mining and milling ‘its nique, shortfiber chrysotile
asbestos near King City, California in 1963. The King City mine was the only asbestos mine
operated by Union Carbide, Union Carbide sold the raw asbestos first under the name “Union
Carbide Asbestos,” and then under the ttade name “Colidtia.” ‘The asbestos was mined-by Union
Cotbide and sold in bulk form to various purchasers who incomponsted and used it in
mannfaoturing various products, Union Carbide did not sell Calidria to the generat public.
Throughout the time that Union Carbide was in the Calidria asbestos business, It remained a
yelotively small player in the ashestos business due to the limited applications in which its unique
Calidrin fiber could be used, In fact, to the bestof my knowledge, from the time Union Carbide
‘began operating fis mine through the 1970s, Union Catbide never supplied more than 5% of the
asbestos used in the United States. "
5. Union Carbide did not market of sell its Calica asbestos for use in gant,
valves, pamps, packing mateciale, pipes or pipe covering, pipe insulation, blork insulation, spray
insulation, boiler Insulation, farnace insulation, compressor insulation, pump insulation, turbine
jnsulotion, seftactory products, acoustical plaster, lathe material, cloth, roofing or siding shingles,
boilers, furnanes, spray on fireproofing, wallboard, dry wall, firebricks, or brakes,

applications associated with pipe tovering, insulation or other high-temperature products, To the
best of my knowledge, shere ate no end usets who used Union Carbide’s Calidria asbestos in
geskets, valves, pumps, packing materials, pipes or pipe sovering, pipe insulation, block
insulation, spray insulation, boiler insulation, fornace ‘insulation, compressor insulation, ‘pump
insulation, turbine insulation, reffactory products, acoustical plaster, Jathe material, cloth, roofing ©
or siding shingles, boilers, furnaces, spray on fireproofing, svallboard, Arywall, firebricks, or

6. As Union Carbide -was a Jate comer to the asbestos business, many of its
customers had been using other types and supplies of asbestos for many years prior to purchasing
Calidria fim Union Carbide. . ,
1 Union Carbide did supply Calidtia for use in mastics. However, I.do-not recall
the names of the manufacturers t0 whom Union Carbide sold Calldria for this particular use.
Union Carbide did sell Calidria to Mensento, but Ido not recall the use Monsanto intended to
make, of did make, of the Calidria. In any event, Union Carbide would not have sold Calidria to
manufacturers, Monsanto or otherwise, for use in any product prior to late 1963, the first year
Uaion Cube mined md sold Calida. The 1963 produetion of Calla asbestos wag limited to
an.amount wvolued at apptosimately $9,000.00.

already lsd established relationships with other asbestos suppliers, to my knowiedge, UOC was

With the exception of a few small sample quantity shipments, UCC never sold a
its Calideia asbestos direcly to Hamilton, All asbestos sales to Hamilton were made through

some testimony. So let's hear anything that you want to
add.
MR. MAYER: Yes. Good morning, Your Honor. This
is an issue that Your Honor has considered previously on
several occasions, and you have consistently ruled that
evidence conceming the Union Carbide worker health issues
should not be admitted into evidence.
By the way, before we begin, Your Honor, Td
like to introduce to the court Ms. Siobhan Handley, my
colleague, who Your Honor has graciously admitted pro hac
vice. We appreciate that. She willbehandling
Mr. Myers' testimony today, and can also amplify if you
need amplification on the issues of the Union Carbide

2 A. Yes. -
3 Q. And there came a time in 1970 where you were
4 the plant supervisor of a mine located near Fresno,
5 California.
6 A. Iwas never called a superintendent of the
7 mine. And it was not near Fresno. Or at least not any
8 closer than anyplace else.
9 Q. Then you became a marketing sales manager
10 about 1970, for Union Carbide's asbestos business?
li A. Marketing manager, yes.
12 Q. And the mine closed in 1985?
13 A. No.
4 Q._ Union Carbide sold off the mine in what
15_year?
16 A. They sold off the mine and milling, the
AA7 entire asbestos operation in 1985.
18 Q. Allright. If this jury were interested in .
19 finding out what Union Carbide lnew about the toxicologic
20 effects of asbestos and when they knew it, do you have
21 some special knowledge in your capacity as running the
22. mining operations for Carbide? Have I got that right?
23 MS. HANDLEY: Objection, Your Honor.

6 different periods of time in that letter?
7 A. Two. Two of them.

19 -Q, And in '68, the warning said, "Warning,
20 Breathing Dust May Be Harmful, Do Not Breathe dust."
21 A. Yes. :
22. __Q. Then the warning got revised in 1972 to
23 read, "Caution: Contains Asbestos Fibers, Breathing Dust
24 May Cause Serious Bodily Harm"?

_ This document is a presentation entitled
"Preventing on-the-Job Cancer," Your Honor. And in light
of the court's previous rulings limiting the case to
asbestosis, | just see some real danger here on opening
the door, and I'm not sure what the relevance is at this
point.
MR. HEALY: I have no intention of getting into the
cancer. The highlighted portion is about the
appropriateness of controls of dusts.
THE COURT; Do you see what he's looking at?
You're going to stay away from the reference
to cancer?
MR. HEALY: Yes.

2 THE COURT: Okay. Let's hear what Counsel is

4 MR. HEALY: Yes, Your Honor. The representation.
5 Jhas been made that Mr. Myers is unfamiliar with medical
6 terminology. This is foundation to show that he actively
7__sought to change a death certificate and has intimate
8_ familiarity with medical terminology relating to
9_pneumoconiosis and asbestosis.
10 Lf this is something I have to do outside
11_the presence, then I'll move on to a different area, but ]
12_do have some material on this.

14 I'm not sure that just becatise someone writes something.
15 How many of us went to school and wrote
16 things that we weren't quite sure of?
17 MS. HANDLEY; Your Honor, I'll add for the record

28 A... The mining and milling and marketing

2 Q.._ What year? :
3 A, 1985, I think it was effective July ist,
4 _1985. .
5 Q. And they sold the mine?
6 A, Well, they didn't own the mine, But, you
7 know, as we discussed earlier, we had claims. These were
8 transferred to the new owner.
9 ,.Q. ‘They transferred claims.
10 A. Wedid own some property where the roads
11 were putin, We had to buy that property. But we didn't
12 _gwn any of the asbestos ore deposit.
13° | .Q. By this time, was Union Carbide out of the
14 raw fiber and -- to joint compound manufacturers business?
15 A. They sold the asbestos business.
16 Q. Did there come a point in time before 1985
17 in which the government banned asbestos from joint
18 compounds?
19 A, Part of them, yes.
20 Q. Allright. And what year was that?
21 A. [think it was 1978 or in that neighborhood.
22 Q. You've testified in other litigation than
23 thisone. Havel got that right? ‘ ,

2 Q. So the deposit was 40 to 50 miles, 40 to 50
3 square miles.
4 A. Again, as I recall, that sounds about right.
5 Union Carbide probably had maybe two or three miles of the
6 area,
7 Q, At this -- this land where this deposit --
8 the deposit was an asbestos deposit, right?
9 AL Yes. ,
10 Q. The largest in North America?
WAL Yes. ,
12 Q. And the asbestos here was ¢alled Calidria?

13 Later, that trade name was adopted.
14 , _Calidria was a trade name?
15 A, Yes.
16 Q. And that comes from California, and Idria,
17 from the name of the mine, the New Idria mine?
As A. Yes, it was the New Idria mining area,
19 Q. Now, this Calidria asbestos was unique in
20 terms of the fiber of asbestos found anywhere in the
-21 world. Is that true?
22 A, It was similar to others, but it had -- it
23 was all short-fiber asbestos, short-fiber chrysotile
24 asbestos.
25 Q. You wrote in 1979 a document describing it
26 asbeing highly sheared and pulverized by nature?
27 A. Yes.
28 Q. And it didn't have the cross-fiber look that

Q._ And you are selling asbestos. Right?
A, Right.
Q. Okay. Who are you selling that to?
A. To companies that mix the asbestos with
other materials to make a finished product that they then
sold to another -- their customers.

this thing. So we're going to have to go a little slowly.
So were one of their customers that you just
referred to tape joint compound manufacturers?
A. Yes,
Q So you sell your product to tape joint
compound manufacturers, correct?
A. Yes.
Q. Among other, correct?
A. Many others. ‘
Q. Okay. And what do they do with it, to your
knowledge?
A. They use to it make tape joint compounds.
Q. Okay. They use it to make tape joint
compound.
