Dear Judge McClusky:
In response to your letter of last week, we completed depositions of plaintiff and a non-party fact
witness in this matter on May 25, 2022, but defendant's claims representative, who was also scheduled to
be deposed on that date, was unable to appear. Plaintiff reserved the right to depose the claims
representative under the circumstances, but counsel for the parties have been discussing resolution of
the matter since the completion of the above depositions.
In the meantime, we have just come to agreement on the settlement of this matter, and expect to
filea Stipulation of Discontinuance shortly.
