Now comes E.W. DeMarse, and having been duly placed under oath and cautioned to tel) the
truth, deposes and states the following: : :
1. fn 1952, I received a B.S. in Chemical Engineering from Washington University in St.
Louis., Beginning in 1952 and continuing until] retired iv 1991, I was continuousty employed by
the Goodyear Tire & Rubber Company. From 1952 until approximately 1983, 1 was continuously
employed by the Industria) Products department in Goodyear’s Plant 2.in Akron, Ohio,
2. From 1952 - 1959 1 served inthe Industria) Products department as a rubber compounder for
& variety of products, including sheet gaskets products, From 1959-1966, headed the Process
Development Group, with responsibilty for rubber formulation reccrds and the factory processing
of all Alcon Industrial Products, including the gasketing products, From 1966 ~ 1977, Iwas Chief
Engincer for of the department's Special Products Group that was responsible for development
control of various products including sheet gasket products, In the course of my work in thatdepartment, I became personally familiar with the design and formulation of the sheet gaskets
products, some of which contained compressed asbestos encapsulated within a rabber binder,
3. Compressed asbestos sheet gasket was produced by The Goodyear Tire & Rubber Company
for approximately 50 years with production terminati ng for economic reasons in 1969. This product
consisted of a blend of asbestos fibers and # solvent solution of compounded rubber thoroughly
mixed together so that the mubber ‘component covered and adhered to the asbestos fibers, This
material was produced in sheet form on equipment known as calendars at temperatures between
280° F and 300° F. The hot temperature resulted in evaporation of the solvent and curing of the
rubber component. The end product was a stiff, rubber-sorfaced sheet made in thicknesses that was
never any greater than '/4," No loose asbestos fibers were present in the finished sheet,

1am readily familiar with the firm’s practice of collection and processing correspondence
for mailing. Under that practice it would be deposited with the U.S. Postal Service on that same
day with postage thereon fully prepaid in the ordinary course of business. I am aware that on
motion of the party served, service is presumed invalid if postal cancellation date or postage
meter date is more than one day after the date of deposit for mailing in affidavit.
I declare under penalty of perjury under the laws of the State of California that the above
is true and correct.
Executed on August 28, 2013 at San Francisco, California.
