Jackson Defendants, ) Dept: 503 ) ) Trial Date: September 9, 2013 } Complaint Filed: December 17, 2010 J TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD: Defendant GIAMPOLINI & COMPANY (“Giampolini”) moves the court for an order in limine excluding all non-party witnesses from the courtroom except for expert witnesses. Authority for this motion is set forth in Evidence Code Section 777, which allows the court to exclude non-party witnesses from the courtroom at the time that other witnesses are under examination, so that such witnesses cannot hear the testimony of the other witnesses. Watson v. Department of Rehabilitation (1989) 212 Cal.App.3d 1271. However, with regard to expert witnesses, courts have held that it is appropriately within the discretion of the trial court to allow such experts to be present in order to hear testimony that «le \Sereer?igen-ins\2O20\SFIOOAGMP MILS\MIL 3 - Excl Now Party Witness.docmay be pertinent to their own expert opinion. People v. Maxey (1980) 28 Cal-App.3d 190, 198- 199, Based on the foregoing, Giampolini respectfully requests that all non-party witnesses, other than expert witnesses, be excluded from the courtroom. Counsel will alert the court and opposing counsel as to the identity of any expert witness in the courtroom, and the reason for their presence before the expert hears any testimony or proceedings.
