(2002) 22 Cal.4th 1127, 1135-1136 and 1145. it EAs fured\ 449tpldlopp- HACINY- yn diaisn wpd 1 PLAINTIFFS’ OPPOSITION TO DEFENDANT H & C INVESTMENT ASSOCIATES, INC.’S MOTION TO DISMISS PLAINTIFFS’ 2010 COMPLAINT FOR ASBESTOS-RELATED PERSONAL INJURIES AND LOSS OF CONSORTIUMDefendant claims that the general language of the 2007 Complaint included the yet-to- be-diagnosed-for-another-three-years colon cancer. However, this language, even if taken at face value, cannot apply to these facts. The severe and permanent injury “including but not limited to breathing difficulties, asbestosis and/or lung damage” cannot possibly include non-existent colon cancer. Colon cancer is not “breathing difficulties,” not “asbestosis” and not “lung damage.” While in 2007 Mr. ROSS properly pled for damages for “increased fear of developing mesothelioma, lung cancer and other various cancers,” that is not - as a matter of law - a claim for damages for the possibility of actually incurring such diseases. It would be impermissibly speculative to award damages for the possibility of getting cancer in the future. (Potter v. Firestone Tire and Rubber Company (1993) 6 Cal.4th 965.) The claim was for the present and justifiable fear of later getting cancer. This Court has twice previously ruled that plaintiffs’ dismissals of claims with regard the diagnoses of asbestosis and asbestos-related pleural disease had mooted various defendants’ claims that Mr. ROSS’ 2010 diagnosis of asbestos-related colon cancer was somehow subsumed into the 2007 Complaint.
