The hearing must be set no later than 30 days prior to the trial date. The 75-day notice prescribed by C.C.P. §437c(a) is fixed by the Legislature and may not be shortened by the Court. (McMahon v. Superior Court (2003) 106 Cal. App.4th 112; Urshan y. Musicians’ Credit Union (2004) 120 Cal App.4th 768.) The Court in McMahon noted that a trial court could not set aside the clear language of C.C.P. § 437c{a}: Sonsiderabie fe and géfort to prepare, a summary dgment motion is perhaps the most important pretrial motion in a civil case. Therefore, the Legislature was entitled to conclude that panties should be afforded a minimum notice period for the eating of summary judgment motions so that they have sufficient time to assemble the relevant evidence and prepare an adequate opposition. (McMahon at 117, 118.) This holding was affirmed in Urshan v. Musicians’ Credit Union (2004) 120 Cal. App.4th 758, in which the appellate court noted that “the statutory language tegarding rninimum notice is mandatory, not directive.” (Urshan at 842, 843.) Here, there is no trial date set in the case, defendant COSCO noticed March 20, 2012, as the day on which its Motion for Summary Judgment/and or Summary Adjudication would be heard. (Defendant’s Notice of Motion and Proof of Service, attached to the Declaration of James P. Nevin as Exhibit A.) Including taking into account the two extra court days added to the notice period when moving papers are electronically served, the last day for defendant to have timely filed a Motion for Summary Judgment/and or Summary Adjudication was January 3, 2012. However, Defendant did not electronically file and serve its Notice of Motion and Motion for Summary Judgment/and or Summary Adjudication on January 3, 2012. As this Court is aware, the express language of C.C.P. § 437c(a), precludes shortening the minimum notice period for hearings on summary judgment and summary adjudication, absent the consent of the parties.
