On December 17, 2010, after being diagnosed with a malignancy, ROBERT ROSS and JEAN ROSS filed a second asbestos-related personal injury action. That second personal injury action does not have a trial date at this time. Under the circumstances, it is practical and efficient for the two actions to be consolidated and for both actions to be tried together given the nature and facts of the cases. Additionally, such circumstances require a continuation of the trial date, once consolidated, pursuant to C.C.P. section 583.340(c) as it will be impossible, impracticable and futile to bring the matter to trial on April 2, 2012.
