May 10, 2013. The hearing is presently set for May 14, 2013 due to the Court’s availability of
hearing dates when the underlying motion was filed.
This is a personal injury case involving plaintiff ROBERT ROSS’s work at various
construction sites where CAHILL has been identified or where plaintiffs have reason to believe
CAHILL performed work in Mr. ROSS’s presence. (Declaration of Anne T. Acufia J 2 (’Acufia
Decl.”).}
On January 4, 2013, plaintiffs timely served on CAHILL a Notice of Taking Deposition
and Request for Production of Documents. The deposition was noticed for January 25, 2013.
(Exhibit A to the Acufia Decl.)
On January 17, 2013, defendant served its written objections to the Notice and indicated
that no witness would be produced on January 25, 2013. (Acufia Decl. 4 4; Exhibit B to the
Acufia Decl.)
On February 11, 2013, counsel for CAHILL, Cesar Alvarado, notified plaintiffs that
defendant was in the process of obtaining deposition dates. (Acufia Decl. § 5: copy of emails
attached as Exhibit C to the Acufia Decl.) On February 21 and again on March 14, 2013, in
accordance with C.C.P. § 2025.450 (b) (2), in a good-faith effort to meet and confer, plaintiffs
followed up with Mr. Alvarado, requesting dates for CAHILL’s PMQ and COR’s deposition.
(Acuiia Decl. § 6; copy of emails attached as Exhibit C to the Acufia Decl.)}. On March 14,
Mr. Alvarado represented that he would provide dates as soon as possible. (Id.)
Since the March 14, 2013, email, neither Mr. Alvarado nor anyone representing CAHILL,
has provided any dates for deposition or communicated in any way why defendant cannot produce
a witness for deposition pursuant to plaintiffs’ Notice. (Acuia Decl. 47.)
To give defendant CAHILL time to respond to plaintiffs’ request, plaintiffs did not attempt
to file the underlying motion until April 10,2013. (Acufia Decl. 7 8.) On April 10, plaintiffs were
tunable to reach the Court clerk in order to obtain available dates for the hearing. On April 11,
plaintiffs were told that the earliest available hearing date to comply with the full notice period
was May 14, 2013. (id.) Plaintiffs went ahead and filed the motion on April 11, with the hearing
date set for May 14, 2013. (id.) Discovery in this matter closes on May 10, 2013. (Id.) As such,

plaintiffs request that the underlying motion be heard on shortened time. Plaintiffs request that
the underlying motion be heard on April 25, 2013 or April 30, 2013. (Id.) Plaintiffs are willing to
waive their reply. (Id.)
Under California Code of Civil Procedure §1005.5 “the court or a judge thereof, may
prescribe a shorter time.” The standard for the court to shorten the notice requirement is that the
motion must be supported by good cause. “The concept of good cause... calls for a factual
exposition of a reasonable ground for the sought order. The good case may be equated to a good
reason for party’s failure to perform that specific requirement from which [the party] seeks to be
excused.” Waters v. Superior Court (1962) 58 Cal.2d 855, 893. Good cause exists for granting
plaintiffs’ Order to Shorten Time of Notice for Hearing a Motion to Compel Deposition(s) and
Production of Documents given defendant CAHILL CONTRACTORS, INC.’s refusal to produce
land the exigency of this matter. This is a personal injury case with a trial date of June 10, 2010,
with discovery closing as to CAHILL on May 10, 2013.
Therefore, on April 16, 2013 at 11:00 a.m., or as soon thereafter as this cause may be
heard in Room 503 of the San Francisco Superior Court, plaintiffs will move for an order
shortening time to hear and brief plaintiffs’ motion to compel the deposition(s) of CAHILL
CONTRACTORS, INC.’s Person(s) Most Knowledgeable and Custodian(s) of Records and for
the production of documents; Motion for Sanctions.
This application is based upon the good cause shown in the accompanying Declaration of
Anne T. Acufia.
Timely notice was duly provided to defendant before 10:00 a.m. of April 15, 2013 of
plaintiffs’ intent to appear ex parte on April 16, 2013 for this application. See Exhibit D to the
Acuiia Decl.
