4 benign diseases caused by asbestos. I have published approximately 200 peer review
5 articles, book chapters, editorials, and abstracts on different issues in the field of
6 pathology, primary oncologic pathology, including asbestos-related tumors and disorders.|
tT As my CV indicates, I have been the recipient of a total of nine (9) National Institute of
8 Health (NIH)/National Institute of Cancer (NCI) Scientific Grants and Institutional
9 Scientific Grants as Principal or co-investigator; all dealing with the study and research
10 of human malignant oncologic diseases. I have been on Editorial Boards of National and
7 i International Scientific Journals. In 1986, my research in oncologic pathology resulted in|
g 12 the discovery of a previously unrecognized malignant tumor for which the patients now
g 13 are receiving proper treatment (Am J Pathol 1986, 124:310-318). My work in
; 3 14 Immunopathology resulted in characterization of antigens now commonly used
4 i worldwide for the diagnosis of asbestos-related malignancies (Am J Surg Pathol
Z 16 10(4):227-236, 1986; Am J Pathol 123:212-219, 1986; Am J Surg Patho! 15(8):779-784,
7 1991). Attached as Exhibit A is a true and correct copy of my Curriculum Vitae.
18 3. have reviewed medical records and pathology materials of Plaintiff Robert Ross in
19 consultation. The pathology includes twenty-eight (28) slides, which I received from
20 Carondelet St. Joseph's Hospital on March 8, 2011.. These slides were prepared from a
21 biopsy of the sigmoid mass in Mr. Ross‘ colon on October 26, 2010 and a resection of
2 Mr. Ross’ colon and rectum on November 8, 2010. From my review of the twenty-eight
23 (28) slides, I confirmed the diagnosis of invasive adenocarcinoma of the colon, which
o4 had originated from a pre-existing benign polyp.
25 4. Polyps are benign lesions that may occur in human colorectal areas. The progression of
26 benign colorectal polyps to carcinoma in-situ and eventually adenocarcinoma is a well-
27 known phenomenon. The data to support the polyp-cancer sequence come from both
28 epidemiologic and pathologic studies. Countries with low rates of colorectal cancer also

have low rates of polyps. Whereas, countries with high rates of colorectal cancer have a
high incidence of polyps (Diagnostic Surgical Pathology, S. Sternberg, 2nd edition, 1994;
p.1381). To my knowledge, there is no causal relationship between colorectal polyps and|
asbestos exposure, and there is no increased risk of colorectal polyps in individuals who
have been exposed to asbestos.
I performed iron staining on fourteen (14) out of the twenty-cight (28) slides from Mr.
Ross’ sigmoid mass and colorectal resection. Iron staining is a procedure by which
pathologists can determine the presence or absence of asbestos bodies in the specimen
reviewed, According to the criteria published by the College of American Pathologists
(CAP) and Pulmonary Pathology Society, one needs to identify sufficient number of
asbestos bodies in lng tissue to establish the causal relationship between lung cancer and|
asbestos (Arch Pathol Lab Med-Vol 134, March 2010). Therefore, it is scientifically
reasonable to apply the same concept to the extrapulmonary cancers, including colorectal
carcinoma. I found no asbestos bodics in iron-stained histologic sections prepared from
Mr. Ross' colon tissue. :
Based on the established scientific facts in medical literature, my own experience and
research in the field of oncologic pathology, and objective pathologic findings in the
histologic sections prepared from Mr. Ross’ colon tissue that showed transformation of
benign polyp to cancer, as well as the absence of asbestos bodies in special stain studies
performed on his colon tissue, it is my opinion to a reasonable degree of medical
certainty that Mr. Ross’ colon cancer originated from a pre-existing polyp. Therefore, the|
polyp should be considered the cause of this patient's colon cancer. As such, toa
reasonable degree of medical probability, the cause of Mr. Ross’ colon cancer is
unrelated to any alleged asbestos exposure.
