All parties were present at the Case Management Conference, or had notice of the Case Management Conference, and none of the attorneys objected to the Court’s granting the Order Shortening Time. The Plaintiff's Motion for leave to file its Third Amended Complaint was heard on April 26, 2011, Hon. Richard Kramer presiding. The court had excused any counsel who did not wish to oppose the motion from appearing in person. The Court pointed out that failure to oppose the motion was not tantamount to agreeing with any of the allegations of the Third Amended Complaint, and did not preclude counsel from filing demurrers to the Third Amended Complaint. Plaintiff appeared by its counsel Ann Rankin of Law Offices of Ann Rankin. The court, having read and considered Plaintiff's Motion for leave to file its Third Amended Complaint, the Declaration of Ann Rankin in support thereof, the Memorandum of Points and Authorities in Support thereof, and the Declaration of Ann Rankin regarding notice to all counsel concerning the application, and good cause appearing therefor, hereby ORDERS that Plaintiff may file its Third Amended Complaint in the form submitted with its Motion.
