INTRODUCTION Plaintiff Beacon Residential Community Association (“BRCA”) requests permission t file a brief of up to twenty-eight pages in support of its Motion for Class Certification. Th statutory limit for an opening brief in a motion for class certification is twenty (20) pages, California Rules of Court, Rule 3.764. The class certification motion is an evidentiary motion Plaintiff's counsel has spent months gathering and organizing the evidence and writing the lega argument, and is still unable to address the complex factual and legal issues in less than twenty- eight (28) pages. Il. FACTS BRCA’s Third Amended Complaint (“TAC”) seeks class certification in connection with claims for concealment, implied warranty, breach of contract and other related issues involving} the solar heat gain and ventilation issues at the 595 unit Beacon condominiums. Many units have multiple owners. Declaration of Ann Rankin, §2. BRCA has spent several million dollar: investigating the cause of and appropriate repair method for the solar heat gain and ventilatio problems that plague the community. /d., 3. To assure standing to bring these claims, BRCA| must obtain class certification. Civil Code § 895(f); Civil Code § 1368.3; Code of Civi Procedure 382. A motion for class certification requires (1) the existence of an ascertainable class and (2) a well-defined community of interest in the questions of law and fact. Jd., 6. The former | subdivided into 3 sub-factors: (1) the class definition; (2) the size of the class; and (3) the meang available for identifying class members. Jd, 7. The latter is also further divided into 3 sub factors: (1) predominant questions of law or fact; (2) class representatives whose claims of defense are typical of the class; and (3) class representatives who can adequately represent the class. /d., §8. Because of the multiple factors which require determination for class certification and the complexity of the factual issues, BRCA’s counsel is unable to prepare a brief in support of this motion that addresses all of the issues in less than twenty-eight pages. At 8:21 a.m. on August 6, 2012, BRCA’s counsel notified counsel that at 9:30 a.m. o1 August 7, 2012, she would apply ex parte to this Court, in Department 304 at 400 Meat Street, San Francisco, California 94102 for leave to file a brief in excess of the twenty pages permitted by Rules of Court, /d., 410. Til. ARGUMENT. A party may apply to the court ex parte but with written notice of the application to th other parties, at least 24 hours before the memorandum is due, for permission to file a longey memorandum, The application must state reasons why the argument cannot be made within th stated limit. Cal. R. Ct. 3.1113(e). Rules of Court Rule 3.764 limits the opening brief in a class certification, to twenty (20) pages unless an application for leave to file an oversized brief is granted. This is a multi-million dollar lawsuit involving hundreds of owners and residents. The facts are complex and involve testimony of numerous witnesses. Plaintiff's counsel has spent five months trying to condense the brief into the smallest number of pages consistent with meeting plaintiff's burden of proof, and has been unable to address all the issues that must be briefed in an opening class certification motion in less than twenty-eight pages. Because th request for leave to file an oversized brief must be made before the brief is filed, Beacon wil suffer irreparable harm if this application is not granted prior to its filing its motion for class certification, Beacon’s ex parte application is therefore proper. Ill. CONCLUSION To represent its hundreds of members, BRCA must apply for class certification. To do so, BRCA must set forth evidence in support of all required elements of required for clasg certification.
