In preparation of the conference, the Court has reviewed Plaintiff's Proposed Discovery Plan for the January 12, 2012 Discovery Conference and the proposed deposition calendar prepared by the Discovery Committee. As a result of discussions off the record, for good cause appearing, the Court hereby ORDERS as follows: 1, The trial of this action shall commence on February 4, 2013. 2, The stay on discovery is lifted as of January 12, 2012. 3. Specifically, Plaintiff is authorized to propound up to 44 requests for admission, one special interrogatory and form interrogatory No. 17.1. 5, Mission Place, LLC, and its affiliated parties (collectively “Mission Place”), HKS, Inc., and Webcor Construction, Inc., dba Webcor Builders, Inc., are authorized to propound written discovery reasonably tailored to the issues relating to Mission Place’s pending motion for summary adjudication. 6. Lay witness depositions shall commence on March 1, 2012. The proposed dates for the depositions of initial round of lay witnesses are set forth in the deposition calendar prepared by the Discovery Committee, a copy of which is attached hereto as Exhibit A. Some of these proposed. depositions have been confirmed as noted in the attached deposition calendar. Unless there is showing of good cause to the Discovery Committee and/or the Special Master, the lay witness depositions confirmed to date shall proceed as scheduled. As to the unconfirmed, proposed deposition dates for these lay witnesses, on or before January 26, 2012, all parties shall either confirm the proposed deposition dates of their respective lay witnesses or provide at least 3 alternative dates for their respective lay witnesses. 7. The Court adopts the recommendation of Discovery Committee to require the depositions of all current officers, directors, managing agents and employees of the parties to this action to proceed at Aiken & Welch, in Oakland, California, regardless of the locations of the deponents’ residences or the principal executive or business offices in California. 8. On or before August 27, 2012, the parties shall serve a statement disclosing expert witnesses they may call at trial, pursuant to the requirements of Code of Civil Procedure (“CCP”) § 2034.260. The disclosures shall provide at least five (5) available dates for deposition. On or before September 10, 2012, the parties may serve a supplemental disclosure of experts pursuant to CCP § 2034.280. All disclosures shall provide at least five (5) available dates for deposition.
