RESIDENTIAL COMMUNITY ASSOCIATION (“the Association”) will move, and
hereby moves, for certification of a class defined as:

All members of the Association as of the time of trial herein, excluding the
defendants and/or other individuals who are or may be liable for the conduct described
in this Third Amended Complaint in this action.

Plaintiff will further request the designation of the following subclasses:

1. A subclass consisting of those members of the Association who own Units

that were owned by plaintiffs in the case of Edward Zucker, et al., v.
Catellus Development Corp., Case No. CGC-06-455352 (“Zucker I’) and
Edward Zucker, et al., v. Catellus Development Corp., Case No. CGC-08-
471272 (“Zucker II”).

2. A subclass consisting of those members of the Association who, before
the current suit was filed on August 8, 2008, purchased Units from prior
owners other than defendant Mission Place LLC.

Said motion will be made upon the grounds set forth in the accompanying papers
filed and served herewith. Said motion will be based upon this Notice of Motion, the
accompanying Memorandum of Points and Authorities in support thereof, the
Declarations of Ann Rankin, Robert R. Riggs, Sung E. Shim, Michael Alfaro, Michael
Lefler, Michael Burgess, Mike McCoy, Jordan Davis and Clara Chun Daniels in support
thereof, as previously filed herein on Aug. 24, 2012, the Request for Judicial Notice of
Plaintiff in support thereof, as previously filed herein on Aug. 24, 2012, the Reply
