Karnow Trial Date: TBD PLAINTIFF’S FURTHER OBJECTIONS TO ADDITIONAL EVIDENCE IN SUPPORT OF MOTIONS FOR SUMMARY ADJUDICATION ON SEVENTH CAUSE OF ACTIONKATZOVF & RIGGS LLP 22 23 INTRODUCTION Plaintiff Beacon Residential Community Association (“Plaintiff”) objects to the entirety of the Declaration of Mark Bledsoe in Support of Defendants and Cross- Defendants Cupertino Electric, Inc., Creative Masonry, Inc., Carefree Toland Pools, Inc., J.W. McClenahan, Inc., Van Mulder Sheet Metal, Inc., N.V. Heathorn, Inc., Critchfield Mechanical, Inc., Blue’s Roofing Company, West Coast Protective Coatings, Allied Fire Protection, and Western Roofing Service’s (“the Subcontractors”) Motion for Summary Adjudication Against Plaintiff Beacon Residential Community Association’s Seventh Cause of Action for Third Party Beneficiary/Breach of Contracts and Subcontracts Alleged in Plaintiff's Third Amended Complaint (“the Bledsoe Declaration”). OBJECTION A. The Bledsoe Declaration Filed and Served on February 8, 2013 Is Untimely and Should Not be Considered In a motion for summary adjudication the moving party is required to set forth the material evidence with its moving papers. (San Diego Watercrafts, Inc. v. Wells Fargo Bank, N.A. (2008) 103 Cal.App.4" 308, 316.) As the remedy of summary judgment or adjudication is drastic, due process requires a party be fully advised of the issues to be addressed and be given adequate notice of what facts it must rebut in order to prevail. (Carabini v. Superior Court (1994) 26 Cal. App. 4th 239, 244.) Subcontractors did not serve the Bledsoe Declaration until February 8, 2013, well after this motion had been fully briefed. Plaintiff objects to the entirety of the Bledsoe Declaration on these grounds. Under these rules the Court should not consider the Bledsoe Declaration. Plaintiff further objects to the Bledsoe Declaration on the grounds that the facts contained therein are not referenced anywhere in Subcontractors’ Separate Statement of Undisputed Material Facts in Support of Their Motion for Summary Adjudication, filed 2 PLAINTIFF’S FURTHER OBJECTIONS TO ADDITIONAL EVIDENCE IN SUPPORT OF MOTIONS FOR SUMMARY ADJUDICATION ON SEVENTH CAUSE OF ACTIONKATZOVF & RIGGS LLP 22 23 herein on November 20, 2012 (“the Subcontractor Separate Statement”). As such, the belated filing of the Bledsoe Declaration violates the “Golden Rule” of summary judgment and adjudication motions that: “Sf it is not set forth in the separate statement, it does not exist. Both the court and the opposing party are entitled to have all the facts upon which the moving party bases its motion plainly set forth in the separate statement.”” (United Community Church vy. Garcin (1991) 231 Cal. App. 3d 327, 337.) Plaintiff further objects to the entirety of the Bledsoe Declaration on the grounds that it is not referenced in Subcontractors’ Separate Statement. Under the “Golden Rule” of summary adjudication motions the Court should not consider the Bledsoe Declaration. Plaintiff also objects on the grounds that the Subcontractors filed the Bledsoe Declaration in violation of an express order of the Court. At the hearing on this motion on January 25, 2013, after the Court stated its intention to continue the hearing to March 29, 2013, the Court clearly and explicitly rejected the request of Subcontractors’ counsel that the Court permit the Subcontractors to file additional papers in support of this motion. If the Court permits the Subcontractors to file the Bledsoe Declaration, or any other additional papers, Plaintiff would need to be allowed leave to address them through a further supplemental memorandum in order to avoid severe prejudice.
