(hereinafter “Webcor”). The following facts and circumstances are personally known to me and, if
called upon to do so, I could and would competently testify as to them. As to those matters stated
upon information and belief, 1am informed and believe them to be true.

2. i make this declaration in support of the Joint Ex Parte Application of Defendants
Webcor and HKS for Extension of Time to File a Writ Petition.

3. 1 prepared a letter giving notice of this hearing and had my office electronically
serve it via Lexis File and Serve on all counsel before 10:00 a.m. on September 6, 2013. Attached
as Exhibit A is a true and correct copy of the Notice of this Ex Parte.

4, On Wednesday, August 21, 2013, Mission Place filed a Notice of Entry of Order
Granting Mission Place’s Motion for Summary Adjudication against Webcor and HKS via
electronic service.

5, Exigent circumstances exist for this ex parte application because under Code of Civil
Procedure section 437¢ subdivision (m), Webcor and HKS have a brief 20-day period to respond to
Mission Place’s Notice of Entry of the Court’s Order. A 20-day period does not provide counsel for
Webcor and HKS with sufficient time to prepare and file a regularly noticed motion requesting a
10-day extension. (A regularly noticed motion would have had to been prepared and filed on or
before August 20, 2013, which is before the August 21 date of effective service of Mission Place’s
Notice.)

6. On September 3, 2013, Webcor and HKS filed and served a Joint Motion for
Reconsideration and/or Clarification within the statutory 10-day deadline under Code of Civil
Procedure section 1008(a). That motion was initially set for hearing on the soonest possible date of
September 27, 2013 and was recently re-set for October 4, 2013.

7. The October 4, 2013 hearing date means that Webcor and HKS’s Joint Reply to any
opposition of Mission Place to the Motion for Reconsideration will also be due by September 23,
2013.

8. Given the constraints of Code of Civil Procedure section 437c subdivision (m),
Webcor and HKS’s petitions to the Court of Appeal must be filed by Thursday, September 12,
2013.

9, I have personally reviewed the briefing related to Mission Place’s Motion for
Summary Adjudication against Webcor and HKS and it consists of hundreds of pages of moving,
opposing, and reply papers, supporting declarations, and exhibits, which makes the pleadings
voluminous and make creating the record for a writ unusually labor intensive. Mission Place’s
moving papers alone include a compendium of exhibits that number 272 pages.

10. On August 24, 2012, I attended the hearing on Mission Place’s Motion for Summary
Adjudication, which extended several hours from the morning through the afternoon with a
transcript of 87 pages.

ll. At the hearing on Mission Place’s Motion for Summary Adjudication on August 24,
2012, the Court ordered proposed orders, which led to further extensive briefing by Mission Place,
Webcor, and HKS over the following year related to various iterations of their proposed orders to
the Court, which I have also personally reviewed. These papers amount to hundreds of additional
pages of record and include an ex parte application of Mission Place to submit an order that alone is
150 pages. The volume of the record on this motion is large, which means that additional time is
required by me and the appellate attorney, Eric Brown in preparing the writ.

2. On Wednesday morning, September 4, 2013, I instructed my office to reserve a time
for this ex parte application for the soonest possible day. I am informed and believe that after trying

repeatedly, my office was not able to connect to the Court until the afternoon of September 4 and

received an ex parte date of September 10. In the effort to have this matter of a brief 10-day
extension resolved as soon as possible and due to the impending appellate deadline, | instructed my

office and IJ too personally called the Court to inquire about an earlier ex parte date. As a result we

were able to set this ex parte for the soonest possible date of September 9.

13. Iam based in Southern California. Due to conflicts in my schedule for Monday,
September 9, 2013, and in the interest of conserving my client’s resources, I am not able to appear
in person at this ex parte hearing, which will instead be handled by my co-counsel and associate on
this case, Ryan Palumbo.

14. On September 4, 2013, I attended a deposition in this case by telephone where
Steven Cvitanovic, counsel for Mission Place, was present in person. Mr. Cvitanovic stated at the
deposition that he intends to oppose this ex parte application; though he did not provide a basis for
opposition other than an unwillingness to agree to any extension of time for Webcor and HKS to
file a writ petition.
