(hereinafter “Webcor”). The following facts and circumstances are personally known to me and, if
called upon to do so, I could and would competently testify as to them. As to those matters stated
upon information and belief, 1am informed and believe them to be true.
2. i make this declaration in support of the Joint Ex Parte Application of Defendants
Webcor and HKS for Extension of Time to File a Writ Petition.
3. Tam the attorney responsible for preparing the writ petition to the Court of Appea
on behalf of Webcor.
4, The record for appeal is voluminous and consists of extensive briefing at the motion
level numbering hundreds of pages and further extensive briefing related to the parties’ propose
orders.
5. The issues on appeal relate to a complicated area of contractual indemnity law.
6, 1 was not involved in the trial court level briefing and so must now review an
prepare Webcor’s appellate filing from an unusually voluminous and complex trial court record.
7. Failing to provide a 10-day extension in which to prepare a writ petition would have
an adverse affect on my ability to prepare an adequate writ petition, which would prejudice
Webcor.
8. For the reasons above, and the reasons set forth in the ex parte application, I request
a 10-day extension of time as permitted by Code of Civil Procedure section 437c subdivision (m).
9. I declare under the penalty of perjury under the laws of the State of California and
