DETERMINING GOOD FAITH SETTLEMENT (CCP §877.6(a)(2))TERMINATION OF GOOD FAITH SETTLEMENT I. | SETTLEMENT PARTIES, TERMS, AND BASIS Defendant THYSSENKRUPP ELEVATOR CORPORATION (“THYSSENKRUPP”) applies ito this Court pursuant to Code of Civil Procedure section 877.6(a)(2) for determination that the settlement described below was entered into in good faith. L Settling Parties: The parties to this settlement are Plaintiff BEACON RESIDENTIAL COMMUNITY ASSOCIATION (“BEACON”), and Defendant THYSSENKRUPP ELEVATOR CORPORATION (“THYSSENKRUPP”). 2. Settlement Terms: a. BEACON agtees to dismiss THYSSENKRUPP with prejudice from this action. Each party is to bear its own attorneys’ fees, costs, and expenses. 3. Settlement Basis: This settlement is entered into without an admission of liability or fault. This settlement represents fair and reasonable consideration and is based upon the evidence land information known to date by all parties. This settlement was reached through arms-length negotiation between counsel and was entered into in good faith after careful analysis by both counsel. i. THE COURT IS AUTHORIZED TO DETERMINE A GOOD FAITH SETTLEMENT L Notice of Settlement And Application By Settling Party A settling party may give notice of settlement to all parties and to the court, together with an application for determination of good faith settlement and a proposed order. The application shall indicate the settling parties, and the basis, terms, and amount of the settlement, (Code Civ. Proc. § 877.6(a)(2)). Within 25 days of mailing of the moving papers, a non-settling party may file a Notice of Motion to Contest a Good Faith Settlement. If any non-settling party does not file such a Motion within 25 days of mailing of the Notice, Application, and Proposed Order, the court may approve the settlement. (Code Civ. Proc. § 877.6(a)(2)). The provisions of Code Civ. Proc. § 877 and Code Civ.
